President Trump signed the Take It Down Act into law on May 19, 2025

Passed with strong bipartisan support (409-2 in House, unanimous consent in Senate)

Key Provisions:

Makes it illegal to "knowingly publish" non-consensual intimate imagery (NCII), including both real and AI-generated content
Requires platforms to remove such content within 48 hours of being notified
Establishes criminal penalties including:
Prison time (up to 3 years)
Fines
Mandatory restitution
Also criminalizes threatening to publish such content

Enforcement:

Will be enforced by the Federal Trade Commission (FTC)
Provides law enforcement with clearer guidelines for prosecution
Applies a "reasonable person" test for determining what qualifies as NCII

Additional Context:

Previously, only AI-generated explicit images of children were federally prohibited
Many states had already banned revenge porn and deepfakes, but this is the first comprehensive federal law

Law specifically targets apps and services that generate nude images without consent, like the "undress" apps
