If a member of the US armed forces was captured, they would be beaten into a pulp until every single bit of useable info was pulled out of them. The US is treating these people with respect.
US laws do not apply to war zones, or even other countries for that matter. After WWII thousands of people were "detained" until it was proved or otherwise decided they were not a threat.
These people DO NOT have the rights that we have in the US.
And while we are at it, the US Armed Forces operates under it's own laws called the Uniform Code of Military Justice. It's similar to US laws in many ways, but also differs. And how the laws and rules of conduct used by the US Armed Forces before, during, and after a war are very different.
