Darren,
I'd like to first caution you and anyone else who attempt to directly collect debts from consumers. You may be subjecting yourself to liability under the Federal Fair Debt Collection Practices Act (FDCPA) or state collection laws that govern the collection of debt by businesses. Debt collecting is highly regulated by both the states and the federal government.
Did you know, for example, that if a consumer asks you to stop contacting them that you can no longer send any communication other than notification that you have filed a lawsuit. Some states require bonds or licensing fees to be paid before you can collect debts in their state.
If your business starts using hardball tactics and a consumer reports you to their state's regulatory agency, do you think they will have much sympathy for an out-of-state pornography business that isn't licensed to collect debts in their state?
AdultRep is able to collect debts in all 50 states because we have obtained the appropriate licenses and posted the appropriate bonds with each state that we collect in. The regulations do vary widely state-to-state, so AdultRep has agreements with collection agencies in each state that we are not licensed to do business in. This allows our clients to recover debt legally and without running afoul of collection laws.
AdultRep's debt collection agreement removes the website of all liability by having us buy your debt outright -- transferring its legal ownership to us. This insolates you against any claim by a state or federal regulator because, you just point to the contract and say, "I don't own the debt anymore. I'm not responsible."
You can outsource this kind of back office grunt-work to AdultRep and let us deal with it.
