Definitely something that should have been thought of in advance and taken care of. Probably a non-compete for the employees here and overseas would be called for. But then again most likely the employees overseas are treated as consultants at best, unless you pay them a steady salary regardless of whether or not their service is requested during any pay period.

Anyway draw up some contracts, have your people sign them or fire them, and then act upon them afterwards should the problem spring up again.
