Two problems here.....
a) Patents are only good for 20 years and I am pretty sure the pedal used to accelerate a car has been around for at least 20 years, so you are outta luck here
and
b) Assuming he did just get this patent approved 10 years ago, I am pretty sure it would not be a problem finding prior art to invalidate it.
