Using your argument then this host would be a safe haven for anyone stealing content also. It is the host problem if someone has illegal content on their servers. Upload stolen content to their servers, run a "Zapster" type site on their servers, etc,etc. Read any upstreams TOS and see what it says about illegal content. you make good points but in the end the host is legally liable for what is on his servers, especially after he is given legal notice of copyright violation on his server. After this legal notice then he can become a party to a lawsuit and thus held liable for any damages awarded. I do not think it will ever come to this, but if I have to put forward funds for a attorney, then I have to recoup them somehow. 99% of the sites using this stolen script are very small and running questionable content on their sites anyway. I doubt very seriously if any of these sites owners are even full time in this business.
