I never made it through law school, but here it is as I see it.
Looking at the case of sex.com, it was ruled that a domain or web address was just like a phone number. So with that as a precedent, links lists would be really hard to hold responsible for anything.
Of course Luciano's is based on mostly on sites with playboy models and stuff, so he's alot more open to it than most. It could be argued that he's not only promoting the stolen content his whole site is built around it.
Also Perfect 10 is fucking hardcore when it comes to protecting their material, they don't think it's funny at all.
It'll be interesting to see what happens, but I don't think it will affect link sites in general, just the ones that focus on "centerfolds"
