Do you have terms with your design sales? As in.. if you sell the rights to your work to a customer, does he have the right to use them upon receipt, or upon payment for the work.. and did you release the design to him? If you released the finished product to him and he hasn't paid for it, it seems that this would be a copyright violation if he is using the design and not paying for it...
