It was MGM who threw a hissy fit. They are for sale for $8 billion, they're going bankrupt. They won the case against Goldmember that it was too close to Goldfinger (bullshit, yes I know), and that it would tarnish the Bond brandname. New Line appealed the first ruling, and before the verdict was given, MGM said they could use Goldmember as long as they delayed it's opening date (so MGM could show their movie before), New Line didn't accept, and then they lost the appeal. So now they've had to do 6 months of re-shooting and change the whole plot. The Spy Who Shagged Me would have been a bit worse for the Bond brand name, and more of an infringement (The Spy Who Loved Me), which MGM didn't sue for.. so it makes MGM look like fucking pieces of shit. Of course they're going bankrupt.
