It doesn't matter when you wrote it. The patent will issue unless you made public the fact that you had invented it. Them's the rules. You have to be able to prove that you released it to the public in early 1999 or before to stop the patent.
This patent is for pop-unders. Popups are irrelevant. Now, if someone claims a patent on the popup . . .
