I disagree with that. If its not published anywhere (ie: not findable through a public resource such as Google or other site), then I tend to think its private.
Is there any legal cases or presedences regarding this type of issue that anyone knows of? Certainly poses an interesting topic if anybody has litigated over private links like this.
