There is no question he went to Afghanistan and joined the Taliban, but there aren't much in the way of laws to punish misguided teenagers who run off to fight with fundamentalist Islamic regimes. The most serious charge is conspiracy to kill americans, and it is that which I don't think they have any real evidence for.
Lindh joined the Taliban as a foot soldier long before the United States came into conflict with them, and it is far from clear that he was willing to conspire with them to commit murder against US military personell after the conflict began.
Conspiracy to commit murder is extrordinarily difficult to prove unless someone is caught in the act or a person credible enough to convince a Jury flips and becomes a Gov't witness. They don't either in this case.
