Nice example , but not even close..

Ifriends is not culpible until they are notified..

Why make an example so far off base , lets make it more realistic..

If mcdonalds hired a company to make burger flyers to hand out infront of their restaurants and unbeknownst to them , the company that made the flyers simply copied the burger king flyer and crossed out "burger king" and inserted "mcdonalds"

While mcdonalds wouldnt be laible , if they were informed of the thievery and didn't take action ( i.e. stopped handing out the flyers , they would be )

And in such a case i wouldn't find it at all strange for burger king to write an editorial entitled " MCDONALDS BETTER GEt THIS TURNED OFF ASAP" even though mcdonalds didnt make the flyer ,furthermore they wouldn't be out of their legal right to say such a statement..
