While this thread is about a very specific issue, a problem even for those who do read the terms is that they often include common but vague rules which are interpreted reasonably by some sponsors and used to beat affiliates over the head by others. In fact given that 40% is closer to a realistic maximum than a reasonable minimum, I would guess that even this rule is "discretionary".

Another consideration is that I have been doing this for 10 years and - apart from the flurry of activity about spam emailing a year or two back - it would be very optimistic to say I have had even a dozen notifications of TOS changes. I seriously doubt that is more than a small fraction of the number of sponsors who have updated their terms. So exactly how often are we supposed to check for revisions?

It's quite a while since there has been a major blowup about TOS being used as an arbitrary excuse for blocking payments, but I am sure a lot here can remember some well-known sponsors being involved in such disputes.
