2257 For Non "Performers"?

We are making a promotional video, where a non "performer" tour guide shows us around town. These tour scenes will be cut together with "performer" video footage as defined by US law.

I would think it's best to get our tour guide's ID, but is it REQIUIRED by US law? I have read the e-CFR Data a few times over but can't be sure.

I am looking for definite answers, so any lawyers who would like to talk, please reply.

Others welcome.

Thank you!

Hi,

If the tour guide does not appear in the "performer" footage, then the answer is clearly no.

You need only create a record when the performer is engaged in actual or simulated sexually explicit conduct, which is defined as actual or simulated:
  • sexual intercourse, including genital-genital, oral-genital, anal-genital, or oral-anal, whether between persons of the same or opposite sex;
  • bestiality;
  • masturbation;
  • sadistic or masochistic abuse; or
  • lascivious exhibition of the genitals or pubic area of any person, as defined under the Dost standards.
In the context you describe, the tour guide would fit none of these criteria. That being said, she might qualify under Dost if she appeared in a sex scene in a non-sex role.

Hope that helps,
Drew
