Manwin is stepping up and saying "We aren't paying this. It's extortion. Nice.

It always helps when a larger company with the backing and legal council sets a course of action.

Homegrown did it with Acacia and it paid off for those who sat back and waited. This isn't the same situation at all as HG was fighting not only for itself but the industry as a whole.

For those without the resources of Manwin watching the outcome of their actions can help others down the road.

The ICM registry itself announced a process by which trademark owners can prevent their trademarks from being registered as .xxx domains.

The ICM registry thereby acknowledged that trademark infringement is a possibility or even a threat.

The fact that the ICM Registry charges $200 or $300 (per domain) to prevent these violations from taking place could be used against them.

This part is key. They aren't straight up locking horns with the concept of the .xxx extension, they aren't going to bat against the possible harm the .xxx extension may have to the industry, they just don't want to pay the fees.

If ICM gives them the .xxx domains they want free of charge it's peaches and cream.

Just let your lawyer send them a letter stating that the ICM will be violating your trademarks if they allow anyone to register yourtrademark.xxx. And then release a press release. That's basically what Manwin is doing.

The problem is most companies cannot afford $90k to protect their domain names, no less take on ICM in court.

Sorry, I do not recall what happened between Acacia and Hustler so I can not make that comparison. I do think it is entirely within the realm of possibility that ICM will give away some .XXX domains for development to give the impression of acceptance. I do not see them giving away domains that will never be developed.

Personally I think it can bring more harm then benefits because this way its easier to filter and block .xxx traffic.

I'm wondering which companies currently support ICM and how ICM is funded.

It's crazy if you have around 100+ domains and later you have to register for each of them .xxx ones.

I think the same.....ICM in time will give away a limited number of domains to the likes of Manwin ( it cant sell them anyway due to trademark issues) then Manwin and others stick big popular website properties on..this leaves the onlooker thinking Manwin and others support and accept .XXX

We are not asking for the domains for free. This is in the letter in case they for some reason can not block it, we want them to block them by registering them. We wil not use the domains. They are a useless hassle.

All new TLDs go through these same issues during their sunrise periods. You apply for the names you're interested in to protect your marks, just like anyone else.
