Trademark (site name) in domains

Just wondering what everyone's stance is on this? The big guys who actually register the name of their site as a trademark have to fight people who use it in their domains to keep the trademark right.

In the sologirl market a lot of sponsors allow it as long as their site is the focus of the blog.. it helps keep out torrents/tubes in the rankings..


What are your thoughts.. wouldn't you rather have an affiliate getting that traffic vs a tube video or fucking kat.ph and extratorrent listings?

I do get a kick out of (usually) larger companies taking the trademarked domain that is ranked and sending sales and traffic just to them only to just redirect it to the tour and lose all of these benefits *cough* *fleshlight* *cough*

I allow it for that reason, I rather affiliates get the spots over filelockers/tube sites. However its a slippery slope because it does suck if they manage to get a bunch of spots ahead of you and basically leech all your sales that would have gone to you if they didn't have your models name in their domain. Its basically a ticket to the top of the search rankings, and because theyre affiliates, they usually have a network to build up backlinks and other techniques. This is their main job so theyre typically working a little harder than you

If you are half decent with SEO and have the models name dot com name, you should be able to beat them out with the purchase of some backlinks. As you do have an advantage.

Depends how confident you are in your ability to get above them before the launch I guess, I had to hold off my launch until I did some SEO work to get ahead of most of them. At the start, I was pushed down and away from page 1 even. Until I really focused on getting back ahead of them. Which is the last thing you want. First thing people do when they find a new model is google her before they signup.

We do allow it as well - our only cavet is that you let us OWN the domain and "lease" it out to you. Lifetime lease - so the domain and the work is yours for life. We welcome any and all affiliates that want to rank for those terms. HIt me up and ill set you up!

Funny you should ask this now

There was a program that changed their T&Cs a month or so ago to stop affiliates owning domains with their site names in the domain.

They have a fasttrack system inside their members area which allows members that have built up fasttracks to view the upcoming sets before they actually go live on their sites. Problem is, nearly all of these full sets are then available on the torrents and forums as soon as they are available on the fasttrack system. It is exactly these torrents and forums that are taking over the slots that affiliates have/could have with their domains.

They are a fairly large outfit, running for a number of years and I thought they had more business savvy than that.

If they throw a fit, or don't convert, just push a different sponsor on there.

Can you clarify why you owning the domain is important? Wouldn't it be 100x easier to just let the affiliate license the use of the trademark instead?

Being that I've had to acquire many trademarked domains for clients it all depends on what the infringing party is using the domain for which in a lot of cases is not to promote the trade marked site.

If it's an affiliate I feel that it is worth while coming to an agreement for the use of the mark but otherwise in order to protect the brand its advised to acquire the domain or risk being misrepresented with no control.

If the sponsor has a problem with it and you are mainly promoting them take it as a warning sign that the sponsor may not be working with affiliates for much longer and plan accordingly.

I'd never register a known trade marked domain though. Now something like "fetishsextube.com" with the owners of "sextube.com" complaining about use of "their" trademark would be met with my promptly telling them to go fuck themselves.

We have made some exceptions for affiliates who sell for us and owned (note the past tense) domains with our trademark names.

Our policy is to enforce our trademarks.
