Cavecreek DMCA Policy

It sucks!

I sent a DMCA notice to Cavecreek hosting company yesterday as one of their clients has ignored three different methods of contacting them to remove links to our content from one of their forums.
Cavecreeks dmca representative responded to my usual dmca email with a request to re-send my notice as a physical signed document via fax or scanned email, or via their own docusign form.
How many people have encountered this kind of practice before?
I've sent hundreds of dmca emails before to file lockers and file sharing forums and never had a problem with my usual offial dmca email before.
Now, I get a response from what I thought would be a responsible host asking me to jump though hoops to get links to our content removed from their servers! I thought it was only file sharing sites that made things difficult for legitimate copyright owners.

The particular offending site is Femaledom.com who are a paysite themselves and I would have expected better from. Yet, if you look at one of their forums such as http://www.femaledom.com/forum/forumdisplay.php?f=81 you will see links like:
Ballbusting Chicks -Not As Expected
BustedBalls.co.uk SiteRip
Brat Princess - Madison - Relentless Ball Kicking
Kinky Kicks -Party Poppers
All of the above are clearly file sharing posts which surely any respectable host would see and act on don't you think?

Cavecreek are partners of CCBill and the latter are possibly losing money by enforcing these stringent requirements in my opinion.
I certainly wouldn't touch Cavecreek for hosting now at any time in the future even if they offered it for free!!!

The actual file lockers have deleted our content now two days after our official dmca, but I'm pursuing the remaining links out of principal that a so called pay site is turning a blind eye to piracy on their site.
Femdom webmasters I would certainly take a look at the forum of femaledom.com and see if your content is also being shared there.

All you have to do is typically follow the posters name. If you want to play whack-a-mole for the remainder of the time the internet exists as you know it then keep sending DMCA notices.

That board is not *nearly* as bad as some but bad just as well.

I know that the forum I named above is a relatively small resource for file sharers compared to some. My beef was with the fact that the file locker (luckyshare.net) dragged their feet over my dmca's so I pursued the forum owner. When the forum owner ignored my requests I contacted their host, Cavecreek. Now I don't expect a paysite owner to ignore dmca's and I certainly don't expect a US based hosting provider to get anal about physical signatures on the document!

I'm very aware of the stop filelockers thread and I posted in there only a couple of days ago with regard to Luckyshare.
However, I wasn't aware of copycontrol.org and will remember that, thank you.

Many of these forums break the individual post URL so they show up as 404. You can see everything via the thread URL but cannot pinpoint the exact URL. By doing so, you cannot provide a specific URL to the post linking to your content via filelocker and every host then gives you this message:

"As with all DMCA claims, we review the information submitted and take action expeditiously in accordance with US Federal Law. Looking at your claim, you only list one URL that is infringing though you reference others. Obviously the sole purpose is too make the process incredibly difficult for content owners and is basically just protecting thieves.

femaledom.com does not currently break the specific URL's but many others do. Probably just a matter of time for them. They also don't have 100's upon 100's of thread posts linking to filelockers, again, likely just a matter of time as well.

DMCA notices are completely ineffective *IF* they are sent to the filelockers, the site owner, and/or the host only. If you do get something removed, it just pops back up in more places then it started.

Remove it from the filelocker... it gets uploaded again with another URL.
Remove it from a thread... it will be in another thread and other forums.
Send DMCA to host, all kinds of bullshit which doesn't even matter except maybe to establish a pattern of repeat infringements.

You can import your signature to an email DMCA and send it to CCbill. They will honor that.

In general, if that will trigger their repeat offender policy and the thieving site will be terminated, it is worth the hassle of faxing them DMCAs. If not, then not. Just send them the usual DMCA by e-mail, cc it to Copycontrol and move on. The time will come when that DMCA will be used as evidence to fuck them hard and to make them pay. Not tomorrow, but all of them scammers will be facing their payday sooner or later.

Whenever possible, spend your time and effort on killing sites, and not merely some links. You can check AK's thread for the list of sites that are being targeted, and join the fight, by sending DMCAs to service providers (billing companies in 99% of cases) and cc-ing them to Copycontrol.

Write your sig on a piece of paper. Scan it. Make it a png. Import it into your DMCA email templates. Then they have a digital and actual signature of you. Never fails and CCbill / Cave Creek allows it.

I can't believe anyone actually still uses faxes. Now that I think of it, their fax machine probably powers their affiliate stats back end. ;-)
