What's with copyrighted music in porn vids.

Not camgirls. But sites with girls stripping to known songs. It's not like the music is playing in the background, they're stripping/flicking the bean to it.

Have you then got the right to bitch about tubes/file lockers etc.

Working with some promo vids for a sologirl program and every video has a known song in it.

I mix and add music tracks to many of my videos. I probably have spent a few thousand to own rights to use hundreds of tunes. Well worth the investment by not having to worry about getting my ass sued off.

It's pretty amazing how many sites out there rip-off all of their music.

Reality Kings was smacked with a major lawsuit for copyright infringement (which I believe they settled out of court), so I would say that anyone who rips music for their site, does so at their own peril.

I spend a lot of money on royalty free music every year, it chaps my ass to see everyone getting away with popular songs on their videos. Wasn't it RK or Bang Bros who was sued a few years ago for this?

A couple of years ago, working on a site with an established porn girl, she had a guy who shot the video while I shot the stills.

He threw together a behind the scenes teaser video for the site, and he used Motley Crue's "Girls Girls Girls" in it (for the entire video length, actually). We had put it up on youtube to help promote.

A few days later, I got one of those "Use of copyrighted material" notices from Youtube. The email said that a video we uploaded contained copyrighted music. But, that they had checked with the copyright holder (i.e. Motley Crue), and the copyright holder had decided to let our video stay up, but that YT would add a disclaimer that the music was copyrighted by another party.


Edit: I just looked at the video (which is still up) and the one we uploaded he actually used Belinda Carlisle's "Heaven is a Place on Earth." Not sure what the fuck he was thinking with that song choice, but it's still up to, but has a link to buy the song on itunes, Google Play and Amazon next to the description. I guess Belinda Carlisle likes porn as much as Motley Crue.

It's all automated. If they think it is copyrighted, they let you keep it but put a link to buy it.

Been like that for a while, problem is there are loads of false positives.

For every one that's been caught I'd wager there are hundreds who haven't, and thus feel they are untouchable due to being one in a sea of millions who do it.

Then there are all the ones who just don't give a shit.

Nice the youtube is at least doing a little something about it, but if the actual holders of copyright want to police their stuff a little closer they should consider offering a "snitch fee" to anyone reporting violators. Then I'm pretty sure more people out there would give a shit enough to report these assholes, and in turn there'd likely be a lot less of it going on.

Ah. This was uploaded 4 years ago, and honestly, I've haven't uploaded shit to YT since then. I'll watch videos and stuff on it, but I never upload, so I'm not familiar with all of that.

I've bought a good amount of royalty free music over the years, have never used copyright tracks. For variation I write my own music now, Ableton on a dedi PC and a couple of synths.

Many camgirls and amateur shooters are unaware of copyright laws and licensing, so they don't even think about it. However, ignorance of the law is not a defense.

If you are caught, you will have to pay in some way. ASCAP is NOT like the porn industry when it comes letting copyrighted material slip away unlicensed. They can, and will, prosecute.

Some musicians, and their labels, are more strict than others however . . . When I worked for EVH, he regularly sued individual strip clubs, carnivals and other small businesses that were using Van Halen tracks without license. Don't even think of using a Metallica or Judas Priest tune, or you'll have reams of legal notices and fees to wade through . . . While Motley Crue, White Snake and some other bands usually let it slide, unless it hits them in the face as being solely used for profit.

The best bet is either buying royalty free, as others have mentioned, or doing licensing direct through ASCAP. You can get some very well known ASCAP licenced music for smaller fees than you would think. (Why some TV shows/movies use particular band tracks, and not others.) The other options are creating your own music or working a deal for licensing (many times free) with a musician you know.
