you need to follow the law of the country you reside in, so if you relocate to the UK you will indeed need to follow UK law.

no restrictions on .co.uk domains as far as i am aware.
hosts vary in their TOS so ask if adult is ok before you purchase any.

You'll need to check out ATVOD if you intend to make editorial decisions in the UK and have video on your site. If so then you are supposed to comply with the 18+ checks etc. Even if you host and run the site outside of the country, but make those editorial decisions here you have to pay.

There are two main regs. to comply with when dealing with ATVOD:
1) You can't show any R18+ content in the free area, that means cock, pussy, penetration. Anything that you would see on TV for example a figure nude in a movie or babe in a skimpy thong on a babe channel you can show.
This brings me onto the first bullshit contradiction about all these regulations. If you wanted to buy an 18 video as opposed to an R18 video in a store you would have to prove you were 18, fine. However 18 level content is streamed via Sky onto our TV sets every night across a multitude of channels with no controls at all, not even compulsory pinning of all the channels.

2) You can only allow people that are 18 or over the ability to join your members area. This is done by only accepting credit cards, debit cards and bank accounts are not allowed.

Atvod seemed to have admitted defeat in being able to regulate UK sites in an equitable manner as they have now suggested to the UK government that they make it illegal for banks to process adult site memberships unless age can be verified. Essentially this would mean only credit cards being used but having it done at a higher level rather than individual site level. This would effect all UK memberships to all adult websites.

I have never known an organisation so utterly clueless and misguided about part of an industry that they are supposed to "know" about, after all they are the regulator.

All governed by OFCOM where the broadcaster resides in the UK. Not all of them do, same as ATVOD which only relates to the UK. Every other European country has their equivalent as it is part of euro wide treaty. Hence why I wouldn't like to be running in tube sites in say, germany or belgium.

Also the content is not strictly what you would imagine an 18 classification is. If they do restrict anyone, then it's just down to how they want their channel allocations to look and pretty much anyone complying with legal broadcasting is allowed to do so. There are plenty of channels you can get on a SKY box by manual tuning that have not bought a "channel number" either from finance or broadcast non-compliant material.

If the purchaser of that channel lies outside of the UK, but conforms to european broadcasting regulations within the country that they operate in then SKY are "almost" obligated to provide services so as to avoid anti-competitive business or something.


However, ATVOD are going to be able to flex more muscle over the coming years as their remit is expanding slightly and they are of course being buoyed up with the massive amount of money already being paid. As they get more money, they will be able to expand their legal and collection teams, probably farming these out as pay/reward options. i.e if you are a legal firm and they send you a list of 500 websites and you manage to get the fee or fine out of the site then you take a percentage as legal "fees".
