YouTube wins in DMCA lawsuit from Viacom; Win for tube sites.

Quote:
The $1 billion lawsuit was filed way back in 2007, not long after Google acquired what was then a fledgling video startup for what was then an astonishing $1.65 billion. Viacom essentially argued that YouTube was knowingly allowing copyrighted material to be posted to its site as a way to boost its audience. YouTube, on the other hand, argued that it was merely a platform that users could add content to, and that it would take down any content that Viacom, or any other content provider, asked it to.
Quote:
Once again, the judge decided that YouTube was protected by the DMCA safe harbor provision, after what looks like some back-and-forth about whether YouTube willfully infringed and/or if Viacom did a good enough job of sending takedown notices.

I remember when some people were thinking this lawsuit was going to end YouTube.

At issue is section 512(c) of the DMCA, which affords safe harbor for websites responding expeditiously to takedown demands. Despite Viacom's arguments that YouTube ignored red flags and refused to institute protocol to filter copyright infringing works, the judge said that statutory protections required more on Viacom's end.
YouTube isn't going anywhere, and neither are porn tubes. Time to stop fighting and embrace them.

Money is in new ways to provide porn, not over offered, or easily accessed product, not in trying to practice the same production model... Capitalism needs to constantly change the production model, to keep going.

It's all about Business.

YouTube business model is incredible profitable. Nobody can end that, no matter how many lawsuits they fill. If the business is working, no stupid judge or court can end that. That's how the Capitalist world works.

Money talks, champ.

By embrace do you mean just let them steal our content. let them allow the uploads of Full videos we do NOT want uploaded?

Or do you mean find ways to work with them?

Find ways to work with them and instead of bitching on the forums because one of them didn't respond to your wrongly done angry email telling them to remove your content without pointing it out.

You think Viacom a huge company's legal team would have DMCA removals down pat, but the judge claimed they hadn't done enough on their end to ensure the removal of the content properly, you think some small town porn company is doing it correctly?

Fact of the matter is almost all the major tubes have content programs and work with sponsors to help them make money, none of them are trying to steal your content anymore, people just don't realize it because they'd rather focus on how a couple sites got started 5 years ago.

Dont get me wrong but I do understand working with them. But they also need to Work with us. Once one of us starts working in their content partner program, they should respond to simple emails to remove content that belongs to us. Instead of having to go through the entire dmca thing. its time consuming.

I know of some of the major tubes who are happy to do that but some of the others big and small ones its time and again the same video from " Uploaders " and its funny how every time we dmca it comes down and goes right back up with a new Uploader name but the same exact video.

Not saying Pornhub is guilty, just using them as an example... They have an Alexa rank of 64... Do you know the magnitude of traffic that is? I know one guy who gets 1,000ish Alexa and says they do about 1.6 million unique visitors a day... Now once you start getting in the 1k's and lower, traffic has to be HUGE to make a much difference in Alexa rank... So 64 has to be some crazy numbers like 6mil+.

With tons of people on their site daily, maybe they aren't lying? How do you know someone isn't uploading under new nicks, ip addresses, etc the same videos? I read an interview with some hollywood movie pirate who says he only does it to send a message to hollywood that their shit is over priced... There's some crazy people out there who do things for stupid reasons... You don't think that happens with porn? How many people do you know who think porn is free and that nobody should have to pay for it? Those same people probably have droves of porn that they upload everywhere and when their accounts are banned, they create new ones and start over...

Pornhub and the likes aren't some single guy running a porn site in his moms basement. They're decent sized companies with a good amount of employees... They don't just reupload the content repeatedly every time you tell them to remove it... Just like YouTube.

But of course, GFY has the mentality that everyone is out to share THEIR content for free in hopes to sell dating or cams ONLY. And that's simply not true... 99% of the users here don't even know what they're talking about.

Hell one user here who is considered a content guy and has a couple of his own sites legitimately believed by spreading adblock programs around the internet to your users, is good to fight tube sites... Can you honestly believe that's a good idea? Now apply that mentality to the rest of the users...

Yes I do believe a Number of the tubes re up those videos themselves. I am not saying its tubes like PornHub etc.. But some of the others do. Its easy to see what the similarities in the actions they use. Also some buy memberships to sites steal the content and then upload them the same day that they are put into the members areas of the sites. I know we have caught a number of them doing it.

Remember that for them its a numbers game as well if they dont have enough Full length videos they will get them or allow them one way or another. To not take down a stolen video that a " User " uploaded makes them as guilty as any one else.

Sadly it makes the people that supply them with the domains just as guilty.

lol, I'm all for not whining about it today - what's done is done, they got away with it, and made a killing. Want some of their traffic? Suck it up and decide whether you personally can work 'with' them. But please let's not use the 'they aren't doing it anymore so you should love them' logic though

We are all stupid.

The television industry did it right. TV used to be free but was supported by ads - commercials. Cable TV was invented, and then we paid for TV but had no ads. Now we pay for cable TV AND have ads.

In the mean time, we give our porn away. Dumbasses.

Nope, stealing my car is illegal. But as you can see by reading this, the judge thinks that YouTube (And anyone else using DMCA) are not breaking the law.

What to expect from a moralist guy that defends the obsolete capitalist moral values of private propriety?

No script, it's a service. Nothing to rip. The script is being given to premium users and is useless without a API key.

You have this skewed view of what's considered theft... I'm sorry, but are you a judge? A lawyer? No? A smut peddler who is obsessed with bitcoins? Yup... I'll take my legal advice from a qualified person. You stick to making 300 threads a day about bitcoins.

Sad little punk. You don't have the guts, otherwise you would steal in the supermarket as well.

Instead you steal on the internet and tell everyone how perfectly fine it is.

I seriously hope you'll get the favour returned. You deserve it.
