A 46-year-old Kentucky man and military veteran who made a wrong turn during a Vermont getaway with his wife and wound up at the Canadian border is facing three years in prison for allegedly trying to smuggle a loaded handgun into the country.

But Louis DiNatale says he didn't want to enter Canada to begin with. He and his wife were on a road trip in upstate New York last September when they were "misdirected by an unreliable GPS," to the Thousand Islands Bridge border crossing between New York state and Ontario, the Los Angeles Times reports.

At the border, DiNatale asked if they could turn around, but was denied. A border patrol agent then asked if he owned a gun.

"I told him I was retired military, I had respect for weapons, and I had a concealed carry license to do so," DiNatale explained in a statement. "He asked me when was the last time I had a weapon on me. I told him, 'Earlier that week.' He asked me again, 'Why?' I told him it was my right as an American citizen to do so."

According to DiNatale, he had forgotten about the Bersa .380 handgun he had stowed in the center console.

Agents searched the car, found the gun, and arrested DiNatale for attempted gun smuggling and lying to border patrol agents. He was released four days later, and a court date was set for June. If convicted, DiNatale, a retired Army sergeant major, faces three years in a Canadian prison.

We should be the same as the Canadians, when they come across with illegal cigars, arrest them for 4 days. I'm tired of the rest of the world getting better treatment here than they give US citizens.

Carbon is not the problem, it makes up 0.041% of our atmosphere , 95% of that is from Volcanos and decomposing plants and stuff. So people in the US are responsible for 13% of the carbon in the atmosphere which 95% is not from Humans, like cars and trucks and stuff and they want to spend trillions to fix it while Solar Panel plants are powered by coal plants

If you're that careless that you "forget" you have a gun in your car -- loaded or not -- then I certainly think that says something about his sense of responsibility, or lack thereof.

Regarding nervousness, it is difficult to believe that a military trained soldier would be "nervous" at being asked a simple question, "Do you have any guns in your car?"

I think irresponsibility is more likely.

I'm real curious, though, as to what war a 46-year-old US Soldier fought in for Canada's freedom.

Not really. Go out to the country. Carrying weapons is not a big deal at all. Carrying weapons is only a big deal to city people. He could have easily forgotten about the gun.

I flew cross-country once with my brother. On our way back, he got stopped by the TSA because he had a deer knife in his backpack. He forgot about it. The guy was nice, said no problem, just go mail it. That situation with my brother could easily have been blown out of proportion, just like it sounds this gun situation is.

Real smuggling is a big deal. It should be addressed. Was this guy really smuggling a gun? Sure doesn't sound like it, but if he was, fine, jail him. If not, jailing him for smuggling goes the purpose of smuggling laws. Is that what we want to start doing? Ignoring intention of laws? It's bad enough as is, let's step it up a notch?

You guys go on and on about jailing people for drug use and you think it's totally appropriate to jail this guy because he took a wrong road and forgot about something in his car.

Sly I am not at all suggesting that common sense should be not be used in this case. I was suggesting, absolutely, that it is pure carelessness to leave a loaded weapon in your car and "forget" about it. I am a gun owner, and a proud one. And guys like him are simply irresponsible - at best. Does it deserve jail time, probably not. Was common sense used here, absolutely not. But common sense is not exactly a common thing on either side of the border when it comes to border security. It's as if it's a requirement to not have any common sense to work at border security, Customs, the TSA, etc.

But I stand by my statement that forgetting you have a loaded weapon in your car, your home, or wherever is complete irresponsibility.

I suspect if he had told them, hey i don't want to cross the border. I haave a gun in the console, i'd like to turn around. Then asked what he should do. He would have been presented with a solution. They take the gun and he can retrieve it back on the US side.

IF i entered the USA and forgot to tell them i had a gun, and they found it...i am sure it wouldn't be a "welcome buddy" fun time.
