The good news is my Hard Drive crashed. I have no record of anything.

I am not sure "having no record of anything" is a good thing when it comes to the IRS, but maybe the IRS in your country are more forgiving than the ones in mine heh.

IRS doesn't give a fuck. Your guilty until you prove your innocence. If you don't have any documents to back up your deductions, you're fucked. They'll come up with their own verdict and sentence and assfuck you like a bitch.

A friend had that happen. He lost most of his records when his basement flooded. The cra were happy to disallow any expenses he couldn't provide receipts or verification for. He ended up owing over 100k and lost almost everything and had to sell his house. He was an idiot anyway, but they sure didnt give him any breaks.

A bank statement isnt enough proof for most items. If I show I was spending $300 a month at bestbuy it could be for toner and paper for my business, or maybe i'm just buying a shitload of video games.

What they will do is double your income and dis allow any expenses that you dont have receipts for. Under tax law they are right and you have to prove your claims. Having no records is going to make this a long night mare. Best of luck.
Give you an idea how fucked up our tax system is
Your 1 st appeal will go to the agents supervisor
2nd will go to a regional administrative
3rd will go to the Irs tax court
4th appeal will finally go to a non Irs federal judge.
Figure 20000-40000 dollars for lawyer fees
You know what really sucks is your hard drive crashed and you have no records.

He is making a point about lost emails that meant nothing. And in that case the irs was doing its job, its not a rubber stamp you are tax exempt. Also if they really believed in what they were doing, they didn't need a tax exempt status to do what they wanted to do.

You cant say gov doesnt work, they are fucked up,ineffective and be surprised they lost emails. The only group that actually lost their tax status was a big liberal group, they look at as many libs as tea party but the rigthies need a excuse to waste our tax dollars so they only focused on tea party groups that were looked at.
I dont know about you but if a group wants tax free status I want the irs to go way up their ass to see if they deserve it.

Good luck with that plan! I had my house raided by the IRS, they took everything with them including hard drives, computers, folders etc.
2 years later they started writing to me I could pickup my things ad they where done with it.
If they think you are hiding something they will take what they need.

I don't know about the US tax system, but here in Sweden they would make an educated guess of your income based on expected living cost, bank statements, traceable spending and investments. If your declared income was less than their estimate they would tax the difference with about 50% and hit you with an additional 30% punitive fee for a total of about 80% in fees and taxes. If you appeal you would have to prove why you have or spent more money than you declared.
I had an audit a couple of years ago, but they were really nice an said my papers where in good order. Only thing they complained about was that I was spending too much money on monitors.....

I am also being audited by my governments IRS right now (currently waiting to go to court). And let me tell you.....they are not kind. Trust me, they will try and fuck you without lube in the ass!

I have records of every single transaction and can explain everything but they don't listen. They make up bullshit excuses and ignores what me and my tax attorney are writing them.

My company accounts got closed down by the banks because off an ongoing police investigation against one of my companies. And as banks in Sweden no longer handles physical cash (I know it's fucked up) I had no other choice then to transfer the money to my personal accounts. According to the IRS I have to pay income tax and payroll tax for it since they consider it salary. Even though me and my attorney explained the situation to them. They simply don't give a fuck!

I wish you all the best and hope that you make it but in my experience that I'm in right now is that it won't be easy fighting those cunts of. Like a previous poster said, they have the power to do almost ANYTHING to you! Freeze your bank accounts, take your house, your car or whatever. It is up to YOU to prove you are not guilty. No other authority can do that!

Like I've always said. The IRS are the worst of ALL authorities! They show no mercy. Period.

If you transferred the money from a Swedish Aktiebolag (LLC) to your personal accounts you are probably screwed. Since you aren't allowed to loan money from your Aktiebolag, they will consider it dividend and tax you thereafter. Better with multiple companies since you can move the money around very easily. As for banks in Sweden not handling cash, that depends on the bank and the branch, but you usually have to order cash a couple of days in advance if you need more than 20K SEK.

I had a friend that dabbled in the day trading market for a year.

He put in about $10,000. On some days he made money, on others he lost money. After a year he pulled about $25,000 out and figured it was something millionaires can have fun with, but not enough money to be made for the average Joe.

He only claimed the $15,000 because he tried doing his own taxes. I told him he should go to a tax guy that year and pay the $70 to have it done right.

IRS sends him a notice saying he needs to pay the other taxes on $300,000 in income. Haha...

He didn't show them correctly that he made $300,000, but lost $275,000 and that $10,000 was the initial investment.

Took him 2 years and an audit before it got straightened out. That was under Bush.

Had another friend do the same thing with being a semi-pro poker player. Only this time under Obama he was able to meet with a local IRS agent, show him his playing logs and the receipts from the Casinos on cashing in/out each session and just like that he is excused.

Hi Dvae,

Please trust me on this, you are making a mistake, and Harmon is exactly right. You ARE guilty until proven innocent when it comes to taxes. And the burden to prove your innocence is on you.

Here is the basics of what is going on. The government wants to review your financial records to see if you are paying the taxes that you owe.

If you can't produce any records of your expenses, the government will look at your income in your bank accounts (and Paypal and Paxum, Payoneer, etc), and ask that you pay tax on the total amount.

As a business owner, you are entitled to various kinds of tax deductions for expenses that you require for business such as office space, computers, etc, but you have to be able to prove these expenses. If you can't, you owe the entire amount. If you can, you're entitled to a discount.

You didn't say how far back they are going, but I'll assume they are going back 2 or 3 years. This isn't so bad and you should work with them to get the info they need. If they suspect you are hiding anything or if there is anything they don't understand, they could go back 5, 6 ,7 years or more. They may also decide to give you a personal audit, or a payroll audit, on top of the other audit.

Here's my advice. Do not claim that your hard disk crashed or deny any documents they request. Hire an accountant instead, and get all of your financial records in order. This will cost you some money but it is money well spent. Meet your auditor with your accountant and let your accountant do the talking. Cooperate with the auditor but only if you think everything is going smoothly. Auditors can overstep their bounds and if this happens, have a tax lawyer ready to jump in.

In Canada, the tax departments can make your life hell by charging lots of interest and even seizing bank accounts. In the US of course, you can go to jail for not paying taxes.

Being audited sucks, but it doesn't have to be that bad. Good luck!!
