After years of legal debate, the Supreme Court has told the cops to keep their hands off Americans? cell phones?at least until they get a search warrant.

The court released a landmark decision Wednesday morning in the case of Riley vs. California, forbidding warrantless police searches of the contents of arrestees? cell phones. The ruling opinion notes that cell phones have in fact become tiny computers in Americans? pockets teeming with highly private data, and that gaining access to them is now fundamentally different from rifling through someone?s pockets or purse. ?A decade ago officers might have occasionally stumbled across a highly personal item such as a diary, but today many of the more than 90% of American adults who own cell phones keep on their person a digital record of nearly every aspect of their lives,? the opinion reads.

Its good they put an end to this. There have been an increasing number of incidents where police confiscate phones at "crime" scenes.

I would be worried. They may treat you very differently if they saw 20 different porn sites on your phone or some post by Ahmed wanting to trade his missiles and grenades for room upgrades or western women.

I dont have anything illegal in my house either but that doesnt mean im going to let police go wandering around my house for no reason.

Same goes for my phone. They're just looking for some reason to fuck you over. Reminds me of when my house got robbed. The prick cop that showed up trampled through my house with his dirty boots on and then when he seen the butt of a gun in my bedroom closet he suddenly got very angry and was getting ready to charge me with unsafe storage. Unfortunately for him it was just the stock I had removed from a shotgun. You could hear the disappointment in his voice once he realized.

Fuck the police. They can keep their dirty mitts off my phone.

I find it amusing that people believe they can speak on my behalf.

I agree with this ruling. While I myself can care less if anyone reads my texts or what not, I believe that our cell phone is our private property - much like our car or our wallet. Police should not be able to search this at will.

This is an exception to SITA (Search Incident to Arrest)

Your cell phone may require a warrant but a search of your wallet in your back pocket does not, when your are arrested, with or without a warrant as the circumstances dictate (in the USA).

Interesting that they would make that distinction. But then the police or the Feds need a warrant to search any computer if they want the evidence allowed in court ... So, the ruling makes sense in that light. Of course, they can arrest you and get a warrant by wire easily enough -- so the ruling just creates a waiting period or an obstacle -- like 20 minutes ...
