Not a Good Day for Kim Dotcom

Megaupload streaming service mogul Kim Dotcom has just been slapped with a civil penalty from the US government. The lawsuit will cost him $67 million worth of assets, including cars, property and luxury goods.

The victory by the US court comes as he lost the right to contest the seizure of the assets.

Dotcom, who is wanted in the United States for copyright infringement through the former file-sharing website, told the Herald on Sunday that this is indicative of the ?sad state? of the US justice system.

"By labeling me a fugitive, the US court has allowed the US government to legally steal all of my assets without any trial, without any due process, without any test of the merits,? he said, vowing to appeal the decision, which his legal team says would likely not hold up in New Zealand or Hong Kong courts.

To me this is the biggest part of the story:

"Last month, a computer programmer and former colleague of Dotcom’s, Andrus Nomm, pleaded guilty to charges of internet piracy and struck a deal with US police, under which he agreed to testify against his former colleagues in exchange for reduced jail time."

Supposedly there are emails and other communications between Dotcom and others working for Megaupload where they talk about piracy and how much they are making off of it. If that is the case and this guy testifies against Dotcom he has serious trouble on his hands.

Sometimes, many times, piracy doesn't pay.

He's going to be the shining example of that, as will many more in our own industry who think it's clever to run a business that is built on piracy.

Just ask the 17 people Metart just sued.

I agree. If anyone else turns on him it will be so bad.

Lessons for Kim.
1. Don't make enemies out of Jewish people.
2. Don't piss off Hollywood.
3. Don't piss off New York.

Kim's comment, "If I were Iran, I'd build a bomb" probably won't make him any friends either.

The screenwriter, William Goldman wrote some excellent books on the Hollywood business. I read them years ago. Reflecting on his work, and thinking of Kim, I knew Kim was fucked out of the gate. He just didn't know it.

I guess he thought he had a magical legal loophole way to encourage piracy. And guess what, looks like that legal loophole that was the cornerstone of his business looks to be closing, fast. In his case, the fine line between being considered a criminal and a "visionary" is very, very fine.

1. He used a US domain name .com
2. He used US hosting (Carpathia and Cogent)
3. He transacted funds through the USA
4. He engaged the use of agents inside the USA.

His straw man arguments do not prevail over analysis of them.

(1) Who wont use a dot com? It doesn't make them any more a US entity.

(2) If you dealing in USD, there always trade settlement in the US in one way or another or through an intermediary. There's not always a way to avoid it.

(3) & (4) may be relevant but since I don't know the full facts of the case I guess I can't comment on that but I'm just going on the face of that statement he made. I always though normally it is residency and management being the issues which most determine where a business is actually based and therefore also the jurisdiction.

You are missing the difference in Poker sites and Megaupload..

Megaupload allowed for theft of products made in the US and owned by companies in the US. Of course the US is going to police that shit because US citizens/businesses are effected.

On the other hand I do not agree at all with US govt going after gambling sites unless they are committing fraud.
