He shot videos with a 16-year-old boy in the USA. Why wasn’t he charged under 18 USC 2257? Is the age of consent 16 in Florida ? Doesn’t 2257 have a provision for “sex while tied up” being illegal due to consent? Seems like a lot of things were overlooked, or not reported on. I’m researching it this week as I’m curious. Filming sex with a teen sounds illegal but if the age of consent is 16 ... they need to change the laws.

And, are are they going after the website customers? Supposedly they can prosecute for viewing and downloading the underaged kid if in a state where the age of consent is 17 or older.

Are the banks going after the processors for selling memberships to a teen having sex with grown men?

Questions my paralegal-school-wannabe mind brings up. Three years for filming and profiting off homemade porn tapes. The market used to be flooded with amateur videos. I bought many in the 90s from folks advertising in personal ads’ free magazines. Three years and 150 men videotaped. Should be three years for each original recording if done with hidden video.

Florida man jailed for using secretly-recorded sex videos for porn website

A Florida man is facing jail time for stealthily recording pornographic videos and running a subscription website.

Bryan Deneumostier, 34, was sentenced to three years in prison by the federal court in Miami for surreptitiously "producing and distributing pornographic audio and video recordings of himself" while engaging in sexual activity with men, the Department of Justice said last week.
The man would, in some cases, cross-dress as a woman then record himself having sex with men, according to a September 20th Miami Herald report.

Deneumostier, a Peru national who used the screen name "susanleon33326," admitted to having sex with 150 men, approximately 80 of the men did not know that they were being recorded and one of the victims was a blindfolded 16-year-old male, the DOJ said.

The 34-year-old Deneumostier was also involved in the operation of a subscription-based pornography website called "straightboyz.net." The site streamed "hook up" videos that depicted sex between Deneumostier and other men. Deneumostier also sold the videos "to a third party located overseas," the DOJ said.

Men who appeared in the videos often did not give their consent.

"In many of the videos, the individuals, at Deneumostier's direction, wore a blindfold and restraints and could not see the defendant or the room (or recording equipment) in which they were located," the DOJ said.

He was also active on social media. In many cases, Deneumostier would use social media accounts or Craigslist to advertise sex-oriented parties or encounters at his home.

"In several of these advertisements, Deneumostier would state he was either a man looking for men (m4m), a transvestite looking for men (t4m), or a woman looking for men (w4m)," according to the DOJ.

Arrested in July, Deneumostier had been held in custody since that time. He was also ordered to serve three years of supervised release following his prison sentence.

He sold video content of non-consensual individuals, that's illegal, as is anyone under 18.

Evidently the prosecutors didn't want to throw the book at him as he will be deported after he's released, they probably saw that is punishment enough on top of his jail time.

I think something isn’t being reported. Eighty men had no idea they were being filmed. A sixteen-year old was filmed. The guy got three years. If anyone reading this did ONE film without consent, we would face ten years or more.

No condoms would add to the charges. Deportation saves us money but if criminals know they can come here from foreign countries, break the law, serve a few years then go back home ...,

It's well known by many foreigners that you can commit white collar, blue collar crimes here, serve little or no time and be deported.

I'm sure the 16 year old said they were 18 or something. Regardless, the guy will serve his time, be deported, snd sneak accross the borders back to America in no time flat

Sucks but that's reality in every country.

If they weren't getting consent that means they might not have even known he was underage. I know it's still illegal but I'm saying the guys didn't know they were coming for a porn shoot. they were replying to craigslist ads for sex and were blindfolded. But I agree they just gave min time so they could deport them. Why put them in a usa prison for a long time when they aren't our problem.

I don't think 2257 is a huge issue. Here's why.

I mentioned 2257 to a friend of mine. He works for the railroad, and his job is to inspect all of the railroad crossings. For every railroad crossing he inspects, he has to file a report that has to be stored, blah blah blah, and feds can come down and look at the paperwork to ensure it's inspected. It's pretty much the same as 2257.

Now... My HOA has a rule that you have to paint your house every ten years. I've been here thirteen years and only seen one person paint their house. A few people are concerned about this because the HOA could come down and demand everyone paint their houses. The rule isn't on the books because they want everyone to paint their houses every ten years... Instead, the rules are on the books in the event someone's house looks like shit and they need to make them paint it.

So....
1) Paperwork requirements are required in some businesses.
2) The laws we have on the books aren't so they can come in and bitch smack us, they are on the books in the event they have questions and quickly want answers.
