Photographers: Wardrobe choices?

Is it legal to have your models wear Abercrombie, American Eagle, etc. clothes if the logo is displayed? Could A&F, AE, etc. hold me liable?

Do you purchase wardrobe? Ever screen-printed your own with your logo? Where?

We buy wardrobe sometimes, but not always. Generally we avoid brand logos like the plague, I don't want to pay royalties.

We buy huge wardrobe choices. We have a four dorr closet full of clothes and dresser after dresser full of panties.

To answer your question we do avoid brands 99.9% of the time. Not only are generic brands MUCH cheaper, but who wants the trouble. Once in awhile we'll shoot in tennis shoes with the nike stripe or what have you, but never the brand name. And we try to avoid it all together.

I'm always shocked when I see photo shoots with Disney sheets or Hello kitty pillows or whatever. I'd sure hate to be them, and have to get rid of that content because of a cease and desect letter. Don't think it can happen? Try and order Anabolic's gangbang girl #20. They had Harley Davidson logos in that shoot, and had to stop selling that video.... you can't find it anywhere now.

They don't want their labels appearing in porn.

They have millions....

..... how much do you have?

Proving you are acting lawfully can be very, very expensive....

Exactly what my hesitation was. Just curious if there would be something to base a suit on. I know that a photograph is automatically the property of the photographer (obviously.. just look at all the nippleslip and candid shots of celebs) but wasn't sure on product usage within those photos.

In Canada, it is very much a grey area.

Having a model use a barbie doll as a dildo is a no win.

But using brand name stuff exactly as it is designed to be used, is almost certainly legal. After all, you are buying it. You are not licencing it.

But litigation is expensive.

Though the lawsuit can be great publicity.

Avoid any prominant display of logos. It's potential trouble with no real upside. You can always buy outfits or costumes online or have them made if you are looking for something specific. And, like someone else said, add our own url if appropriate.
