Hit & Run driver sentenced

Hi guys

Here is the question of the day:
What do you get, when you commit felony hit & run by running over a motorcyclist and leaving him laying in the street, while on probation for your 2nd felony?

Answer:
You just get more probation.

Thats right, folks. For your third felony, you just get 3 years probation. You dont even get your drivers license suspended.

His actual sentence was this:
3 years probation
Inpatient drug program (more on this below)
20 hours community service
And thats it.

He had two other cases against him, and they combined all three into one. The other 2 charges? Possesion of controlled substance and probation violation (which was the posession of the controlled substance). I guess committing a felony and causing serious injury to another person, while on felony probation, isnt considered a probation violation.

His other 2 felonies are drug related. This is why he got the inpatient drug program, which I would be surprised if he even spends 3 months in it. The man belongs in a prison, why doesnt Nevada have a 3 strike rule?

The man caused me considerable pain and almost put me into financial ruin. I had to sell my car and I came very close to having my home forclosed on. Spent 2 months in a wheelchair, 2 months on crutches, and still had to walk with a cane for 2 months after the doctor cleared me to walk again. I'm left with a metal plate & screws in my knee, which still hurts quite a bit, and limited range of motion in my left knee and left ankle. I cannot walk without a limp unless i'm wearing soft shoes. Running? forget about it. Skating with my kid, who plays ice hockey? forget about that also. Stairs and inclines are still a challenge.

How much restitution does the guy have to pay me for all the personal injury and financial damage that he caused? Not a dime.

The judge over the case was Nancy Saitta, 8th Judicial District Court, #18 Las Vegas, NV 89155. I think she would be better serving the community by hanging up her robes and working as a clown for Circus Circus.

So be careful on your bikes, guys. Within a few weeks there will be a drug crazed idiot on the roads who has already demonstrated that he will run a biker down and just leave him laying in the street.

MrPheer, I'm very sorry to hear justice wasn't served. I'm not familiar with the exact event of things although I remember that this happened to you. Why wouldn't you be able to sue his insurance company or sue him personally? So if you would have been totally paralyzed and needed care for the rest of your life, who would cover that after they force you into bankruptcy?

This pisses me off - probation? WTF is that going to do for society? Community service? PULEEZ - that won't pay your bills for sure! How many more years do you have to work to recover financially at the point you were when you had the accident? + the years you lose to get there?

I'd say find another lawyer that will find a way to get you compensated - if he isn't going to suffer in jail, get the money you lost, even if it won't give you the quality of life you had before. DAMN this pisses me off!

Had a similar case. Friend and his girl were hit by a mexican in a delivery truck. Even though the guy was delivering for a company , they pulled off the plates and claimed they had no insurance. End result $1 million in rehab bills and $0 recoup as the other shmuck had no insurance and the driver was an illegal alien , so nothing happened at all.

My cohort recently got busted for drinking and driving ( one point over the limit , asleep in his driveway ) He got 1 year probation , aa meetings , license suspended.

Because he didnt have insurance. he was driving a uhaul truck, and I did get the maximum that uhaul has to pay for liability, which was $15k in Nevada. But I had to fight for it, so I got $9k after the attorney got his share. Plus it took over a year to get it.

He is a total loser, and has no assets to attach or even a job, so no wages to be garnished. Suing him would just be a waste of time and money, and cause more aggravation and stress.

Will, (even though you hate me ), I'm just glad you're OK. The outcome really bites from a legal standpoint, but I'm so very glad you weren't maimed for life. You were lucky in that aspect. Take care.

That is absolutely horrible to read, is this regarding his criminal or civil suit? I assume you can still go after him for pain and suffering and financially cripple him for what he did to you.
