California Restaurant Smoking Ban

can someone give me some more info on the smoking ban ?

is there a total ban on smoking in every restaurant ? or whats the deal there ?


I am thinking of opening a smokeroom where you can eat if there is a total smoking ban

They have a few bars that hide it, but they get fined by the cities whenever the cops find someone smoking in there. It's gotta be outdoors if you want to allow smoking. But when you open that smokeroom let me know i'll be a regular

it wont be a normal restaurant , but a smokeroom where you pay $5 admission fee

They don't shut you down. They fine you for breaking the smoking ban law. I want to say the fine is $150-$300, which they could slap on you everyday, but as far as I know, violations of the smoking ban law are not enforcable through the Health Department, so your shop can't be shut down, just implement a cover-charge, and give some of us VIP free-admission 50% off cards.

it's correct that it's a fine, which they definitely can implement every day - and while i don't know what the mechanism is that they would use to close a business down, i would have to believe that the LA clubs and restaurants that cater to the very-upscale market would gladly pay the daily fine in order to allow their clients to smoke --- if that were really an option.

and if you serve food, i believe you're covered...whether you call it a smokeroom or anything else.

there has to be some loophole on that law


if its illegal to open an establishment for people who smoke to meet with each other , then yes this is impossible, but if you can open up a special business that is directed at people that want to smoke and not at people that want to eat you should be able to work something out

the no smoking rule is based on the discomfort people that want to eat and dont smoke could experience when confronted with cigaret smoke when eating ,

but when you enter a SMOKEroom you KNOW there will be smoking and thus it should be possible

When I did smoke I hated going to Cali due to the smoking ban but now the state I live in, Floida has the ban but you can smoke in some places if they make less than 10% of income from food sales. Pool halls, bars...

In Utah you can't smoke within 35 feet of any publicly used building.

ha , that should be easy to bypass


just open up a "restaurant" but with a twist ,

you open up a place and charge admission , then you hand out free food

of course the admission cost would cover that , but technically your income is not the food but the admission

I can tell you a major loophole in the law in california, and it is supposedly the only legal way around opperating a smoking establishment.

You MUST be the sole employee of the establishment.

If you are the owner/opperator of the business and you have 0 employees you may allow smoking within the establishment.

The law in california is meant to protect employees. Thus if you do not have any employees you can decide if you want to allow smoking or not.
