word from canadian lawyers about Canadians & 2257

The advice I was given was pretty much exactly what I had expected.

'Maintain all records according to the new regulations, post the Custodian of Records address on your pages as required but do not under any circumstances allow ANY US agencies access to inspect the documents or Canadian authorities (unless the Canadian authorities have a valid warrant - as then you've gone beyond the scope of 2257 anyways and have bigger problems).'

[all said tongue-in-cheek]

In theory this should protect you from being detained while on a vacation to the US out of the blue.

What about sites hosted in Canada? What about Canadians that use CCBill for billing on their paysites and had to give a US address? Man I need to call a lawyer, I have way too many unanswered questions.

As far as I can tell that is solely up to your host and your processor, not the DOJ.

(until the DOJ leans on them that is.)

As you stated, it's pretty much what most of us Canadian/Foreign Webmasters who have been keeping an eye on this thing have concluded. We simply CANNOT break a law in our own Country to satisfy the laws of another.

I think the bigger problem that a Canadian (or other) AFFILIATE faces is the way some sponsors are dealing with this issue. Many are now stating that NO hardcore material may be used in the promotion of thier program.

Will the Canadian governement turn me over the the DOJ beacuse I don't have full model releases posted under a thumb on one of my sites? No.

Will some sponsors cancel my account if I don't follow thier compliancy rules? Quite possibly.

It is in this way that the new laws affect us more than anything. Make no mistake, us foreign webmasters have some work ahead of us if we want to stay above ground...

I'd be shocked if none of the sponsors moved offshore, but we may need to wait till the 23rd to hear that info.
