Yeah, partly the driver's fault, but the biker was clearly going over the speed limit. Also the car was turning in so slowly that the biker could have seen the car from a distance, but looks like he didn't bother hitting the brakes.

It's almost as if the guy in the car wanted that to happen. I mean, before you turn don't you look to see what's coming at you. If a guy is on a bike traveling fast you'll see him and while he may be an idiot for travelling fast, I'd just wait until he passed. Jesus.

umm i didnt see any speed limit posted.. he couldn't have "clearly" been going over the speed limit if we dont even know what it was..

Barring any unseen things, this is totally the cars fault.. you can tell there was no other traffic in the bike's lane so there was nothing to interfere with her/his view ( the cars view )

The person just pulled across, then looked , tried to stop , but it was to late they already had their bumper out.

whos to say that off to the left of the screen could be a blind hill, perhaps the biker topped the hill doing the speed limit right as the car was turning. No way to judge or know who was at fault merely by the small frame that the video shows.

i agree with this assessment, if you look carefully at the speed of the video (people are walking and running about 2/3rds normal speed) the bike appears to be going about 50mph on the video, and probably close to 75mph in real time.

WAY too fast for residential area on a street with many areas of ingress/egress.

legally you're correct, but there are mitigating circumstances...

the biker was clearly speeding. so the person in the car sees the small object in the distance (not realizing that the guy is doing maybe double the speed limit) and starts the left turn.

and the biker is going so FUCKING FAST he can't react fast enough.

a judge will decide this one; normally true it is the car driver's fault, EXCEPT in this case the biker is speeding.

moral of the story---if you are a biker ride the bike to protect yourself, don't depend on the law to protect you from injury.

this biker was going too fast for the conditions.

judging by the video, it doesn't look like hes going ridiculous fast obviously it looks a lot faster since he comes to a dead stop.... but keep in mind... even going 50km(30mph) to a dead stop you will fly quite the distance...

it's still the drivers fault, he should be aware of his surroundings... if the guy on the bike was going like a 100mph i could see why the driver would think he had a lot more time to turn... but it's not like hes travelling THAT fast..

1 mph = 1.4 feet per second..

guys ... 60-70mph on a road like that is not fast ... it didn't look like he was going any faster then i would in my car on that road ... it looks like the car didn't see him and panic when he did... the car stopped in the middle of the lane .. if the car would have continued with the turn the bike most likely would have been fine ....

Well when an accident like that happend. This is exactly what the cop told me.

The Biker has the right of WAY he is going stright. He can be going 10000 mph and it's his LANE but because there was no cop to see him speeding he is 100% in the clear. The Car was making a left turn. And did not fail to yeild to on coming traffic. As you can see in the video the car was in both lanes before making the left into the gas station.

good, but use as a referent the speed of people walking and running in the video---these are speed that can be adjusted by tweaking the video speed so the people look "normal"---and then once you get the people looking "normal" speed, THEN do your estimate of the motorcylist velocity...

and you will see beyond a shadow of a doubt the guy is going WAY FAST for that suburban street.

the speed of people walking have nothing to do with how fast he is going.. them walking faster or slower doesnt make the bike faster or slower. Theres a timer in the corner of the video , i used that as a reference point, and the fact it corresponds with real time.. = he was going 40 or slower.. show me two frames a tenth of a second apart where he clears more than 4 feet

Well define "fast". That is such a relative term. In our part of the world the speed limit is 65 on most 2 lane roads and 70 in some areas.

He could have been going "fast", but compared to what. He was obviously ging fast compared to the stopped car he hit, but maybe not "fast" compared to the legal limit.
