Why the fuck didn't they get this info out of the girl before they even made the charges. I didn't know if the chick was lying or not, but I did give her the benefit of the doubt that she wouldn't be stupid enough to make false charges.

In fairness she did say she didn't know if penetration occured or not and she was almost passed out drunk. But still, this is way too late to be saying that.

Still, the guys got themselves set up by arguing with a stripper....man that is just the wrong thing to do. If you get ripped by a drug dealer or a hooker just cut your losses and get the fuck out of there. at all. No one I ever heard of ever sued a DA and won. I could be wrong but I'd like to know if anyone ever heard of such a case.

This case has almost never been about her ever since this prosecutor opened his mouth, which is a real shame! If there was a crime, it needs to be addressed. But I think it's pretty clear that this was always about his reelection, not a search for the truth.

Its like when they grab a guy, that " LOOKS " like the suspect. They take him into custody, and they tell him. If you dont confess, we will give you 25 years in jail. If you do confess, you get 3 years probation. The guy has a past, so he thinks. Fuck it. I did not do it, but no one will believe me, so he takes the three years probation. Even though he is NOT the guy. They know it, and he knows it. But it is another bad guy under thier belt.

It happens every day. But they are not liable.

Lets look at the reality of the situation. Nifong is still throwing up the lesser charges for ONE reason and ONE reason only. He knows they won't stand. He's playing his little mental game of trying to save any kind of face from his horrible situation that he created to get re-elected. Even an average attorney will destroy his witness, if you can even call her that by this point with all the nonsense that has come out. And those guys will be utilizing high powered attorneys.

Nifong is toast, so make the popcorn and watch him swirl around the bottom of the toilet and get flushed away.

Plenty of players at plent of universities have been in trouble with the law and the season was not cancelled. This one how ever had all the team on the scene where problem occured.

If someone has a college scholarship for sports they have to keep their partying on the "down low". Any incident whatsoever can blow up in their faces. The players should have said "FUCK, these chicks ripped us off...ask them to leave and keep quiet" and I think that would have been the end of it. $800 is nothing compared to what they lost now.

DURHAM, N.C. (AP) -- Prosecutors dropped rape charges Friday against three Duke University lacrosse players accused of attacking a stripper at a team party, but the three still face kidnapping and sexual offense charges.

According to court papers filed Friday by District Attorney Mike Nifong, the accuser told a prosecution investigator on Thursday that she now does not know if she was penetrated during the alleged attack.

Nifong had previously said he could rely on the woman's account because of a lack of DNA evidence against the players.

Lacking any "scientific or other evidence independent of the victim's testimony" to corroborate that aspect of the case, Nifong wrote, "the State is unable to meet its burden of proof with respect to this offense."

Nifong did not immediately return calls seeking comment Friday, and a sign posted on his office door read, "No media, please!" The county sheriff's department said no one from Nifong's office would comment Friday.

Both rape and sexual offense carry the same possible sentence of up to 40 years in prison, while kidnapping is a lesser felony punishable by up to 17½ years behind bars. Under state law, a rape charge requires vaginal intercourse, while sexual offense covers any sexual act.

The accuser, a 28-year-old student at North Carolina Central University, has said three men raped her -- vaginally, anally and orally -- while holding her against her will in a bathroom at a March 13 Duke lacrosse team party where she was hired to perform as a stripper.

The indicted players -- Dave Evans, Collin Finnerty and Reade Seligmann -- all say they are innocent. Their attorneys have consistently said no sex occurred at the party and cited a lack of DNA evidence as proof of their clients' innocence

"It's highly coincidental," said defense attorney Joseph Cheshire, that the charges are being dropped a week after the director of a private DNA testing lab acknowledged that he initially, with Nifong's knowledge, withheld from the defense test results showing none of the players' DNA was found on or in the accuser's body.

Testing also showed that genetic material from several males was found on her undergarments and body.

"The reality is, what else could the DA do?" said Stan Goldman, who teaches criminal law, evidence and criminal procedure at Loyola Law School in Los Angeles. "Once the DNA evidence came out last week, I can't imagine how they could sustain a rape charge."

But Wendy Murphy, a former prosecutor who now teaches at the New England School of Law, said the decision could actually help Nifong by keeping any discussion about the results of the DNA testing away from the jury.

"It may be that this is a strategic move to insulate the trial itself from a sideshow that certainly would have overwhelmed all the other evidence," Murphy said. "A sideshow about her sex life."

Even so, the changing story hurts Nifong's case on the other charges, Goldman said.

"It strikes me that a case based on this particular complaining witnesses' credibility appears to be in jeopardy," he said.

Defense attorneys have said for months that the woman has told several different versions of the alleged assault, and Seligmann's attorney has said she has given investigators at least a dozen different versions of the alleged attack.

The defense also has argued that the woman misidentified her alleged attackers in a photo lineup and they have asked the judge to prevent the accuser from identifying the players from the witness stand.

Evans graduated from Duke in May, the day before he was indicted. Sophomores Finnerty and Seligmann were suspended following their April indictments. A Duke spokesman said school President Richard Brodhead would comment later Friday, and the players continued to get support from the university's new lacrosse coach.

"We still believe in the truth and we believe the other charges are false," said John Danowski, who replaced former coach Mike Pressler, who resigned in the wake of the rape allegations. "We'll stand by these kids and their families until the whole thing comes to a conclusion."

It is very apparent that their are inner mixed race issues at heart with some of your comments.

Where was all this outrage when Kobe Bryant got charged and all charges were dropped when he was accused of fucking a pure angelic white teen angel who ended up having 3 different sperm samples in her vagina and undergarments.

I appreciate what you are trying to say PL, but lets face it, there is a gross miscarriage of justice in this case. I know of Nifong and his history, and his loving to go to trial......he's an out of control egomaniac who capitilized on this situation to win re-election, pure and simple. He's the nightmare prosecutor who only wants to win, even if those being prosecuted are innocent. Thats why the charges of the 3 will go ahead, but he will fail bigtime. I am acquainted with the case, and the witness as you should know is a complete joke.

Now she "can't remember if she was penetrated or not" and this comes out right after the DNA results, THAT NIFONG REPRESSED AND TRIED TO BURY, have clearly exonnerated the 3 accused. So their "story" against the 3 accused shifts like the sand in the desert to accomodate the latest "facts."

This witness will be utterly destroyed on the stand, and the 3 will walk. As they should.
