9 months for killing sombody - WTF???

Interesting short article about a guy who got only 9 months in prison for killing somebody. I don't really understand why this guy didn't get life or something more harsh than only 9 months. I mean he did kill somebody

He was convicted of criminally negligent homicide, which basically saying he was blinded by the moment and not in his right mind when he committed the crime. A crime of passion.

If it was your child how would you react with the accused only inches from your face?

What does how I would react have to do with anything?

The fact that a man can beat another man to death and only get 9 months is damn fucked up in my eyes. We have a justice system for people who break the law and he took the law into his own hands and killed another human being. he hit a guy and the guy died as a result. there was no intent... no premeditation etc. basically the law sees it as an accidental death.

again... he hit him. he didn't intend to kill him. had he hit him with intent to kill him it would be murder. had he taken some measures to plan the event out, it would be premeditated murder. he did 9 months because it was not intentional. you can do a lot of things to unintentionally kill someone... doesn't make it murder.

a guy killed my mother when i was 15, drunk driving, in the wrong lane, at night... with his headlights off... resulting in a fatal head on collision. he got 5 years and served two. the law does not see it as murder. simple as that.

actually.. it says in the story that he plead guilty to Criminally Negligent Homicide. Negligent homicide is when someone dies of the result of someones negligence - i.e. your child is sick... you decide that God will heal his burst appendix and refuse to take him for medical care and he dies. i would guess that criminally negligent homicide would be that you were breaking the law in the course of the death - i.e. illegally assualting the person that resulted in their death.... with the death being unintentional.

Anyone remember the Ellie Nessler case?

She shot the accused abuser of her son in the court room and barely did anytime and in fact was treated as a hero.

Her planning to sneak a gun into a courtroom and shoot this man was a clear case of 1st degree murder.

This man, hearing his daughter say 'he molested me' and the accused standing right there, he, most likely in a blind rage swung.

do you see the difference?

He was charged with second-degree murder and did a plea on negligent homicide. It would appear the prosecution were satisfied with his plea?

There are probably more factors underneath - ie any existing rap sheets blah and how convincing the story unfolded in court etc. Who knows what the history of the victim was - he could be totally innocent or a raving pedo. Either way, the defendant has no right to kill him, tho the court obviously believed the defendant never intended to cause death.

But... he's lucky to get off with a very low sentence.

Remember one guy who was convicted for murdering his wife - he ended up serving only 15 ish months (and had to report regularly for a few years after). Apparently the court accepted his wife was a total nag and made his life intolerable to the point of tipping him over the edge. Again, suppose it's all in the detail and what the court knows of the background in making their assessments.
