If secondary exemption is no longer protected by FSC, it's end of alot of tools for U

So, if the FSC loses in its fight to keep secondary producer exemption, or whatever it is...

USA webmasters using only sponsor content can kiss the following goodbye.


RSS Feeds that have pictures
Thumbed TGP or thumbs/images on any site period
Pictures in Blog Posts
Banners
FPA/HPA
Consoles
Iframes
Plugins


Because only a very small handful of sponsors will give you docs.

I don't think 2257 is anywhere near as bad as everyone is making it. If they would have hit us right away. BIG PROBLEM. Everyone has had plenty of time to get their eggs in a row?

we have 2257 docs for all our content and its all orginized online. If any of our affiliates need access during a raid or whatever we have them covered..with a press of a button.

We spent alot of time and money making sure all our ducks are in order

the affiliates need the documents at their own place of business organized the same way you as a primary producer do. telling the investigator that your sponsors have all the documentation online in an easy to view database isn't good enough now.

That's not going to save any affiliates ass.
That's 3rd party custodial, which isn't allowed.
The law stats that any person who displays content has to have their own records.

This also bypasses certain cross referencing requirements. Particularly the part that contains urls of every url image appears on.

Last time I logged in to pornopushers I did not see anything there for me to add all my urls.

i would simply make a blutongsporn.sponsor.c0m link to the content, and thus therefore not hosting the content, would probably get by... kinda lame
but I don't see how they really could stop anything like this which I why I think the law will fail in the first place... perhaps you have to bring it to their attention how easy it would be to get around any law like that...

how could you find me guilty for linking to a pic on someone elses server?

teks, with "due respect", google isn't very interested in third level domains, and a huge number of clones of sponsor RSS feeds onto third levels would pretty get it all wiped out. Useless.

My feeling more is that NATS and others will come up with a "US WEBMASTER" filter, and that will block access to all sponsor content that is hardcore or otherwise requires 2257 documents for US based webmasters. Essentially, anyone who's offices (and publication location) is outside of the US would have access, and everyone inside the US would not.

This is very similar in nature to the whole toolbar / zango thing... the programs will move to where there is money being made. They can toss pretty much every US based webmaster under the bus and still make as many sales, and have as much traffic as they do now. Traffic sources aren't as important to programs as end results. If they happen to have to deal with mostly webmasters outside of the US, well, I am sure they will do it and enjoy the results, which won't be different for them.

However, I will say that any secondary producer webmasters based in the US are pretty much about to get a royal, unlubed reaming like you ain't ever seen.

if you run a TGP or link site that accepts submissions, watch out for the redirects... they are coming BIG TIME.

I don't think that's gonna work. If you link to image via text it would probably be okay (if I understood you correctly) but if the image is on your page (ie hotlinked) you still need the docs...even if it's a softcore image from what I understand. If it is an image of a girl's hair and it links to a hardcore pic somewhere else, you still need records. That's what I have gathered.

Jace: As I attempted to imply in the other thread, I seriously doubt 2257 fucking over Americans isn't gonna send your ratios through the roof...most webmasters aren't even U.S. based. Perhaps 5% of webmasters will close shop. Anyway, it's great that you poke fun at U.S. webmasters in hopes that you'll make an extra sale every week.

And you are one of the VERY few - most sponsors have just gone about their business pretending that it just doesn't matter. Even the new tools that most have created, including RSS feeds, are created as if we're back in 1999 with no 2257 inspections to worry about.

I've asked various sponsors about this over the last couple of years, and the usual answer is "when the time comes."

Maxcash also made our promo materials not explicit and we did that ages ago. It is also the reason that all of our promo content is hosted content.
