I'm taking legal action against myVirtualCard/Paymonde. Who wants in?

Remember Merchsolutions? I took action last time this happened and managed to get my money. See this thread to refresh your memories:

For Merchsol I got a lawyer, aussie police, and other authorities involved (can't say more but my arm is pretty long) and it gave results.

I've been processing with MVC/Paymonde for the past 2 years with no issues until today. I even got paid last week and the week before.

email porn at pamporn dot com and lets regroup and go after these guys as well.
We might not get paid, but they won't get away with our hard earned cash. I'll get things going once again.

Has anybody heard of an Alex Karin at paymonde sales? He called me three days ago offering me a merchant account. Said I'd be approved in 1 week and that all payouts would be sent out. He's also the one who told me Joshua and Howard were there with him in the office but I am pretty sure that that was a lie. I know for a fact that Joshua wasn't there that day so Alex Karin lied to me. I'd like to get his personal info and find out in what way he's implicate in this story.

Like i have been saying...josh is good guy...he was my rep at mvc...he left there in june over summer...him and me had a good connection...he was going back for studies...I liked him alot, and think that he had nothing to do with it...he seemed to be very honest with me...

NexusXI paid me the 8k they owed me after 8 months. Honest guys!

2000charge paid after 7 months. Good CIE.
I never used ibill. Sorry for those who did.
Globosale never paid me. Swiss bank laws made it impossible to track.
Globill, I never used them.

I think its a good track record considering the events and it does show the possibility that my statement is correct. We'll find out soon enough.

They can not keep on rebilling clients....that is a very serious problem.

Nexusxi was an exceptional firm, and when they went down, they sent an email within 72-96 hours that they will pay. And for sure after 8 months, out of the blue, they send another email with the money.
I am not so sure this will happen again.
you have to remeber that even they were not approcahed by any legal authorities as far as I know.
Unless some action is taken all this will simply be wasting one's breath over a great theft and tragedy

MONTREAL ? Third-party payment processor Paymonde has officially gone out of business, CEO Howard Cohen told XBIZ. The company?s demise came after its bank in the Philippines lost acquiring rights to process Mastercard transactions.

?We weren?t left with much of a choice but to go out of business,? Cohen said. ?We have not received payment from the bank, and until we do so, I cannot pay what is owed out of my own pocket. I?m fed up with being beaten up on the webmaster boards. We?re trying to do our best in what is a shitty situation for everyone involved.?

The bank owes Paymonde three weeks of payments and had promised him a settlement Friday, but has still not made good, Cohen said. Cohen could not offer a timetable for webmasters to hear about money owed.

?I want to let everyone know I?m not running away,? Cohen said. ?I?d like to thank all the webmasters that did business with us over five years for their trust and support. I feel terrible for all involved. I?m not a crook. Paymonde is not iBill.?

Cohen promised to evaluate each one of Paymonde?s merchant accounts ?on their own merits.? He said the company is planning to contact every webmaster that is owed money about their financial status, including the amount they are owed.

?What I hate about this whole situation is people on the boards calling me a thief and a scumbag,? Cohen said. ?We tried to take care of all of our clients. I know many of them personally. We were at the shows. We never hid from anybody. We charged lesser percentage [per transaction] than others. And also, everyone should know the big guys like Paycom or CCBill are not immune to this. If their processing gets pulled, how can they pay??

While the Paymonde website is down, Cohen said the company will allow clients into their backend to check on their financial status if they contact him by email.

Sorry for the bad terms, I only know them in French; but for a money case, since you are alot of ppl with actual evidences and records of your transactions (I believe) I think someone locally here should ask for a juridic advice from an attorney from here and then know how to proceed; I have once went against a school to be refunded trough small claims although they wouldnt take a 'collective complaint' even if other students were claiming the same story. It also depends on how much we are talking here and how many ppl are gonna get involved... Good luck all.

OK... If you are reading this board Howard - First, your company failed to answer email and phone calls. Some call that hiding. You failed to take care of your clients and simply closed the doors. Up to this time you still have not contacted those clients. This conduct clearly would raise concern among clients - what else do you expect?

Contingency plans play a major role - not only in any biz, but with offering financial services. Clearly there were no contingency plans.

Now you are suggesting a client needs to contact you by email to gain access to their financial data? Why is that???

PS As aside.. who exactly is "Paymonde"? Is it an LLC, S.A, Limited Company? You even had clients signing up under an unknown entity called "Paymonde". Hell.. you need a lawyer who can drafted a basic contract. I give up on crap.

Many webmasters are contacting me every day. Solidarity is a good thing and will give us way more credibility when it comes to get authorities to act, especially considering the amounts now invloved. Don't listen to the critics, just join us and lets all work together on this, even if we are competitors in this biz.

Many times before in history, small businesses have joined forces and pressured the gvmt or important conglomerates to cave in. Paymonde has to come clean or we will need to get justice served.

I will not yet accuse paymonde of any criminal intent. People don't become criminals overnight and these guys have been honest for nearly 3 years. They need to pull out with class and not by ignoring us. They lost their merchant and screwed up on how to manage the situation. They did some HUGE mistakes here but they can catch up and work this out with us. In fact, they are still making a BIG one; continuing the customer rebills, probably not to lose their Visa account and keep the money rolling in for as long as possible (just a wild guess) and it should stop right now. if you are still processing, you are still getting paid by the bank so we should be getting those funds and not an offshore bank account or a funds2go trustfund.

I will keep you all updated via e-mail. Can't post what we have been doing on the board.

The CEO/Owner/Associates/Whatever are not on the run. Waiting 6 or 7 months for our funds isn't a problem (at least for me) but you (the managers) need to come clean and talk to us. An Xbiz interview just won't do it. We need to keep contact, have a link to you, get informed on a timely and regular basis on the outcome with the banks... This would calm everybody down and help settle everything in an appropriate manner.

I'd appreciate it if Howard Cohen would get in touch with me. You know who I am and how to reach me. Thank you.

ppl are sick of getting fucked in the ass by shaddy billings...these guys didnt say anything for weeks, while paymonde was collapsing...nobody from paymonde say shit ... just promises that everything fine....

and they continue to rebill, and funds2go still continues to operate....

AS OF THIS POST, I HAVE 7 REBILLS AND 10 NEW SUBSCRIPTIONS.

THEY ARE STILL ACCEPTING PAYMENTS AND REBILLING.

I AM AN AFFILAITE, AND MY RELATIVE WAS /IS THE MERCHANT. i still have access to my mvc control panel and im still getting rebills and sign ups.

My theory is that they were trying to work something out with their bank before calling it quits. Sure, they weren't totally upfront about what was going on, but Bill Clinton didn't come clean about getting a blowjob at first either. People had to drag it out of him. He wasn't a crook; he was just embarrassed. Likewise, I'm sure that Howard was scrambling to figure out what to do to avoid closing down.

It's hard to admit failure. I'm sure--knowing Howard--that their intentions were good.
