Facts about tube sites and DMCA
ive seen some things written about "illegal" tube sites/DMCA, and i have some background on this, so let me share some of what i know. please feel free to critique or correct me.
DMCA 1. If an ISP (in most cases the host, in some processor) gets a DMCA notice, they are required to "expeditiously" get the content down (inform their client to remove the infringement or take that client offline). That means if you let them know about it, they have to take action or risk being sued as contributing to the infringement, which they likely want to avoid. 2. If an ISP gets notice of clients that "repeatedly" infringe, they have to terminate them, otherwise they run the same risk as above so in theory, if notices are sent when copyright infringement occurs, the bad stuff should phase out, or at least a system can be created to encourage this, assuming the servers fall under the reach of US law

yea, the biggest problem in my opinion is that people feel the DMCA process is cumbersome, dont understand it very well and hosts dont end up getting many DMCAs

So while suing the tube site might not be a option, going after their host or even domain registrar might be. I know if it was my content I'd be serving DMCA notices to anyone that might even possibly be able to be sued. Get the paper trail going now even if it's fruitless because eventually the laws will come around.

whenever i get a dmca notice, i fold it into origami and then wipe my ass with it...
after i'm finished with that, i rename the file name of the stolen content and change the user name of the "random person" that uploaded it... case closed... |
