Facts about tube sites and DMCA

ive seen some things written about "illegal" tube sites/DMCA, and i have some background on this, so let me share some of what i know. please feel free to critique or correct me.

DMCA

1. If an ISP (in most cases the host, in some processor) gets a DMCA notice, they are required to "expeditiously" get the content down (inform their client to remove the infringement or take that client offline). That means if you let them know about it, they have to take action or risk being sued as contributing to the infringement, which they likely want to avoid.

2. If an ISP gets notice of clients that "repeatedly" infringe, they have to terminate them, otherwise they run the same risk as above


so in theory, if notices are sent when copyright infringement occurs, the bad stuff should phase out, or at least a system can be created to encourage this, assuming the servers fall under the reach of US law

Lets see years ago people cried about TGPs.... then MGPs.... now tube sites.......

Now we all know TGP's "borrowed" content if you think otherwise then you are naivve , tube phenomena will phase out....

Think deep and hard and ask yourself... WHICH BIG SPONSORS ARE RUNNING THESE TUBES AND OTHER WE HAVENT HEARD ABOUT YET??????? i bet all you hypocrites are sending sales to them right now....

So in conclusion......look at the big picture.... if you are so vigilant against this then LOOK REAL HARD who you are using as sponsors or billing for and low and behold the truth might open your eyes.

yea, the biggest problem in my opinion is that people feel the DMCA process is cumbersome, dont understand it very well and hosts dont end up getting many DMCAs

dude, tube sites scare the hell out of me, not as much the infringement but making it so easy to access mass quantities of free porn, and its only going to get worse.

and yea, i know that the tube site owners prob upload some of the vids themselves, but im sure they also know that 1 out of 10,000 copywritten vids will get reported, if that

thats not quite a good example. most of the LARGE tgp's and mgp's did not "borrow" the majority of their content. the majority of the content promoted the sites the content came from , quite a big difference i would think from the large tube sites.

You seem to be missing one very important factor in your reasoning. TGP's and MGP's were not hosting stolen members area content. Granted some people my not have liked them for this reason or that, however content theft was not one of the reasons.

Illegal tube sites host stolen content and by copyright laws value and damage done can be placed on each infringement separately. So while suing the tube site might not be a option, going after their host or even domain registrar might be.

I know if it was my content I'd be serving DMCA notices to anyone that might even possibly be able to be sued. Get the paper trail going now even if it's fruitless because eventually the laws will come around.

whenever i get a dmca notice, i fold it into origami and then wipe my ass with it...

after i'm finished with that, i rename the file name of the stolen content and change the user name of the "random person" that uploaded it...

case closed...
