Nevertheless he reprensents Navisite/Jupiter so I hold them responsible.

The letter you got would be from a collection attorney. They could possibly put a lien against your home or something like that. You need to immediately demand, IN WRITING, proof that you owe this debt to them. They may not still have the contract. If they can't provide proof then they can get fucked. Do not talk to them on the phone. Don't use email. Do it the old fashioned way and document everything. I would also kill this thread since you basically admit to owing them money and hope they didn't see it... :2 cents:

I dont admit I owe them.

I canceled the hosting. Left...

They tried billing me month after month after month after month after I left and told them multiple times I was gone and to stop.

Can and will this collection agent attorney go this far? Or does he just want to shake me down for a settlement on something he paid pennies on the dollar for?

Ethersync 12-19-2008 09:13 PM

Yes, they sometimes file lawsuits for large amounts of money like this. You need to send them a letter telling them to prove you have this debt. You can probably find an example letter online somewhere and just fill in the blanks. Seriously though... kill this thread :helpme

mmcfadden 12-19-2008 09:25 PM

oh jesus... believe me I know about host/servers gettin ya by the balls. Mine almost fucked me big time... still working on it...

You, I believe, own you sites via registrars and solely getting possibly fucked by a hosting company... juniper. i read your documents and there is no way a judge will let that fly. Many states small claims are 10k or less... some 3k... either way... it is not worth their time.

I assume the entity does not exist any longer because you could also file complaints with the BBB.

Keep posting things like this and it will all work out... remember... don't pay a dime and it's still yours

Achmed 12-19-2008 09:29 PM

boner man you tell me I find these persons i make problem dissapear

pocketkangaroo 12-19-2008 09:29 PM

I honestly wouldn't worry. They are not going to find an attorney in your area and file suit against you over that amount and with no case. Tell the collection agency to stop contacting you. They are required by law to stop all correspondence.

It's just a desperate attempt by a company to hopefully nab a few bucks. Companies like this are usually in financial trouble. I would be surprised if they weren't out of business next year.

AdultEUhost 12-19-2008 09:34 PM

hit me up, i know a thing or two about hosting contracts.

(not trying to sell any hosting but offering to help you out)

Its a real attorney in my area though.

Iron Fist 12-19-2008 09:42 PM

Holy fuck... $90 a meg? You should change your tagline to "More money than God" if you can afford hosting at $90 a meg. Good god.

i'm tap dancin around a fucking registrar who can't communicate, respond via emails, tickets, etc. It's like they just completely disregard the english language... SERVAGE... that is.

Don't worry about attorney's calling you... i've had so many attorney's in the past and there is NO WAY they would call me over a couple K problem. YOURE gettin calls by some thugs...

File with BBB... https://odr.bbb.org/odrweb/public/GetStarted.aspx

Ethersync 12-19-2008 09:48 PM

Dispute the debt and make them furnish proof you owe this money. If they can not provide the proof, which is common, the entire matter is over with. No more stress, no hit on your credit report, no more problem.....

Use the letter here: http://privacyrights.org/Letters/debt1.htm

I remember The Fly - he was a cool cat. I never knew why he got banned but what your saying makes perfect sense. Doesn't surprise me a bit that Lens would ban someone for something as petty as this.

file with the bbb man... 9K is small claims in many states... it doesn't matter though. File a complaint... 99% of companies settle immediately because its a big deal to have red flags

DeanCapture 12-19-2008 09:59 PM

Bone - you should hit every single adult webmaster board that you can find and post about how Jupiter is trying to cheat you out of money and how difficult they are to do business with. If I were doing business with Jupiter, this would be enough for me to wanna find another host.

Deal with the BBB after the matter is resolved if you want, but the first thing to do is use the template I gave you a link for and send off a letter to them. Send the letter registered mail too. DOCUMENT EVERYTHING!

Boneprone,

Paragraph 'C' is strange. Does it mean if you cancel your 'service', they can continue to charge you until THEY find someone who wants the same hosting setup you had?

If that is the case, that is totally fucked up.

baddog 12-19-2008 10:17 PM

I can't believe you guys are talking about the BBB like they have some kind of pull. The Boy Scouts would do you as much good.

The first time I read it I thought it meant you can only cancel if you are upgrading.

boneprone 12-19-2008 10:21 PM

After talking to some friends of mine in the hosting biz, it looks like this IS LEGIT...

It was a shitty contract from the start.....

It was signed on October 22, 2004..
In the contract it says it auto renews Every year.

I canceled my hosting with them in November...

Which means I am responsible for paying the rest of the 12 months even though I left.

This is what the legal part of the Contract says.

So legally it looks like I owe them $9,000.00

This is Bullshit............ How shady..............

Ok. Now I need to find out what to do. Not sure if I can even fight this?

Fucking Jupiter....

Yeah thats what it means.

"Agreement shall renew automatically for successive one year term. "

I dont see a termination fee but they can charge for the remainder of the term left on the contract?

Which would be uhhhh,

$696.00 X 12 Months = About $9,000.00

Is this just common? It seems so shitty.

Regardless if you think you owe it or not if you take my advice you may end up not having to pay anything at all.

boneprone 12-19-2008 10:27 PM

If I had canceled with them 3 weeks prior on a 10mpbs, $696.00 per month server it would have saved me $9,000.00

And a lot of headache.

Specifiacally other than stopping with this thread (which I will not) what was your advice?

I mean im being fucked here. I want it to be known. I stuck my reputation out for this company. Worked hard in helping build GFY and even Jupiters Reputation in the Adult Industry and now this happens.

The people who started this contract on me were the owners of GFY and Jupiter. Still are owners of GFY. Granted they arent the ones enforcing this contract's horseshit but they started it.

This just burns in every which way.

Fuck everyone. Really fuck Everyone.

Fuck the Old owners of Jupiter and Fuck Navisite..

Before im done im going to be sure the reputaion of this company is known.
