Bone - you should hit every single adult webmaster board that you can find and post about how Jupiter is trying to cheat you out of money and how difficult they are to do business with. If I were doing business with Jupiter, this would be enough for me to wanna find another host.

why not? sometimes u need to get some help from other people... i sure needed it. I'm talking SERVAGE indicated to me that I didn't own my site while it was down... that was my income...

This site, for me, helps out and alot of fuckin people listen... If I or anyone else gets screwed it should be heard...

After talking to some friends of mine in the hosting biz, it looks like this IS LEGIT...

It was a shitty contract from the start.....


It was signed on October 22, 2004..
In the contract it says it auto renews Every year.

I canceled my hosting with them in November...

Which means I am responsible for paying the rest of the 12 months even though I left.

This is what the legal part of the Contract says.

So legally it looks like I owe them $9,000.00

This is Bullshit............ How shady..............


Ok. Now I need to find out what to do. Not sure if I can even fight this?

If I had canceled with them 3 weeks prior on a 10mpbs, $696.00 per month server it would have saved me $9,000.00

Specifiacally other than stopping with this thread (which I will not) what was your advice?

I mean im being fucked here. I want it to be known. I stuck my reputation out for this company. Worked hard in helping build GFY and even Jupiters Reputation in the Adult Industry and now this happens.

The people who started this contract on me were the owners of GFY and Jupiter. Still are owners of GFY. Granted they arent the ones enforcing this contract's horseshit but they started it.

This is a really shitty situation.

It's a really onerous contract, but Bone prolly didn't even read it before signing it because he trusted Lens and crew so much. They go way way back.

Then Jupiter gets sold and the new owners are really milking that shit for all it's worth.

If the termination fee added up to the number of months left on the contract....that being the one year auto extension of said contract, then that would make sense.
If they're quoting you 5K even, then it sounds like they just pulled that out of their ass....or now want to charge you back rent on the server that was "comped" since you're leaving.

Either way, these seem like pretty shylock tactics. For a $9K bill, you'd think one of the higher-ups in the company would call you up to explain everything to you.

I doubt a such contract is even legal, this kind of product devaluates a lot... you can get a 30mbits server for 200 a month now.

Well it looks like 5k is for the remainder of the year.
The contract auto renews every october. I left in November.

So for the year its 12months X $697.00 = About $9,000.00

Thats how they get it.

You definitely need to take that contract to your attorney and let him/her look it over.

Even if you signed it, sometimes shit in contracts are so onerous that it voids the whole thing.
Either way, a phone call from a competent attorney might grease the wheels for a settlement of less than $9000, especially if it saves them from having to go to court and then pursue you via a collections agency.

Im sure it is legal.

Its wrong, but its legal. Its a contract. I signed it and didnt read it. If I had I would have closed my server down 3 weeks earlier and would have saved $9,000.00

There's another forum dedicated to webhosting, huge one. Most host out there have reps that post there. I've noticed most of the host out there will defend themselves if there's something bad posted about them there. Most webmasters probably know the forum I'm talking about. If you don't know give me your ICQ and I'll tell ya the url. You would be able to warn more people and might get more answers there...

I have read every fuckin post on this thread... I have also delt w/ host companies keeping my site for ransom... and still paying for it. You can always open a case if BBB doesn't have it on file... this is fucking bullshit and when this thread ends I hope boneprone gets justice... meaning...

NO more fucking contacts, emails, etc. to say he owes money. I've dealt with this bullshit and now will make it a priority that this shit happens no more.
