Jesus christ quit being a dip and take the $3500 offer. You've already lucked out that they're not just calling your bluff because this isn't a case of hardship or actually having any actual basis to dispute the amounts.

Contractually, you don't have a leg to stand on and you've already done arguably as well as a lawyer would have, even if not, you've not had to pay any such fees which is your pickup.

If they knew there was a thread that had dozens of disgruntled customers inside it and that it was setting a collections precedent I can assure you they would be happy to retract their settlement offer.

If you settle you need a mutual release before you pay them anything and it needs to be written appropriately. We've already 'navigated' clients through 'Navisite' settlements, payment plans, full releases. Just call or email me after 11:30am est.

If they had accepted my $2800.00 I would have very truthfully done it for sure. It looks like they are still trying to push me around. $3500.00 wont do it.

I havent been in a Court Trial since 2001.
I may need to dust off my Suit...

Less stress this time around. IF I lose I just write out a check. Last time around I was fighting for my freedom.

Im actually looking forward to it.

People always say these things never make it to trial.

For some reason my attorney said that last time I took something all the way to trial... Why cant we go the distance??

I rode my bike 200 miles in one day last summer just to prove to people that I could ride Seattle to Portland in one day. They said that would never go the distance.

I like the challenge.

Ive gotten tons of private ICQ's of people in the same situation as me with these guys. From people dealing in the hundreds of thousands $$$ to people dealing with just a several thousand $$. All the same story.

And not one person but me has talked public about it yet and is willing to take this all the way just for the sake of doing it.

If some of you bigger guys are reading this, if I take this to trial and win it really does help your case.

Unlike some of you bigger guys I have a lot less to risk.. Consider that.

Maybe let me borrow your legal tools so I can take this all the way to the end.

I know that over here, in Brazil, it would be illegal for them to be charging you a termination fee for a service contract on auto-renew.

Retracting back on my original offer may have upset them.

Meanwhile the Attorney they hired here locally to come after me is getting ready to make a move. The deadline he gave me to communicate with him was 10 days. Which would be the 26th.

I like the counter offer of your counter offer idea. Say you needed to pay for a blown water heater and that was $600 up front, plus $150 for the installer. You only have 1750 now so they need to take it. Who knows what else might come up

After paying them for 3 years of hosting I'd tell them to gfy with their 1 year auto renew term. Your a gambling man; get a lawyer and tell them to fuck off or you'll counter sue for time and cost. I don't see that contract holding up after that amount of time and when you canceled a mere few weeks late. Add in the fact the company changed hands and your service went down the shitter. Give them the big ole :321GFY

what was the SLA for the hosting
if the service went to crap when they switched ownership, then you could have a right to claim the termination was not a choice but a breach of the contract on their part.

Boneprone, you can't offer 2800 and then offer a lower amount after they counter with 3500.
That's bargaining in bad faith and it will cost you if/when this goes to court.

Their offer is $700 higher than yours. Based on the contract, you owe them $5500 more than their offer....plus any fees or costs they incur trying to collect the debt.
So you're betting $5500 to win $700.

That's a sucker bet.

Not to mention you'd spend more than $700 for even the cheapest sleeping-in-front-of-the-emergency-room attorney.

here is what you do. tell them you will send them a check. wait a month or 2 phone calls from them, whichever comes later. then wait another 2 weeks or 1 phone call. send the check in for 2200 with "paid in full for hosting balance" in the memo line. if they call you after that, tell them to send you the check back and you will reissue one.

No. I dont want to play games with them.
If I pay them it will be in full for the amount I offered.

If not it will go to the courts if they so desire. No games.
They can take what I offer or they can try to come and take what they think is theirs via the legal system.

Im fine either way.
