I had a a massive customs search when I entered the USA a few months ago, posted about it here, and it was the only time I have traveled with content. I had a ton of it, 13 months worth shooting in Asia. I usually ship it back but this time I was running behind and there was just too much of it to ship in such a short notice so I just packed it, like an idiot, and traveled it.

They said they were looking for CP, no problem, I had all my IDs and documentation. I'm a happy expat for a reason. Fuck this place. I'm feel bad, but thankful, for heroes like Dave and his kind who actually put their lives on the line for this pile of shit that American has become. After I go back home this time, I doubt I'll ever be coming back. Why bother? To be treated like a criminal for no reason at all? I'll pass. :2 cents

Its a long decision (72 pages) with several Judges writing dissenting opinions. It was a 11 to 6 decision. This one is going to take a little time to read and analyze.

No offense but the community is/has lost all faith in the FSC. If I was some hick in the heart of the USA with no contact with the outside world I would not make that statement, but I'm not, I live here, in the heart of porn valley, and I talk to hundreds of people on a monthly basis in the course of my porno travels. Driving stakes through hearts takes cash. Lobbying takes cash. Teeth = Cash. The FSC is running around gumming a bunch of things right now, including piracy. Too many irons in the fire and no one to stoke the fires.

The court used a "reasonable basis" standard. Since this involves speech "time place and manner" issues, didn't the US Supreme Court mandate an "intermediate standard"?

I strongly doubt that the US Supreme Court would grant certioria on the Connections case. There currently stands no conflict between the Circuit Courts. Further, why would a conservative Supreme Court grant cert just to uphold the constitutionality of law that is not yet been really challenged.

If there were several cases involving 2257 pending and several Circuits all with different holdings as to its constitutionality then perhaps it would be an issue that the Supreme Court would want to address.

Remember the US Supreme Court denied the state of California's request to hear the Freeman case, in which the California Supreme Court decided that porn production was a protected right under the First Amendment. If the US Supreme Court would have heard and upheld the Freeman decision, porn production would have been legal everywhere.

And a challenge to the new regs is going to be even more difficult now that third party custodians are allowable.
