Some business advice!

I really shouldn't be one giving advice. But someone icq'ed this to me so I thought I'd pass it along.

"Before you register a domain that you plan to invest a lot of money in and make huge you should probably research and see if it is violating a Trademark"

Sounds like good advice. What do you guys think?

One could argue that facebook, or playboy could have been considered generic when they first started.

youtube sounds generic, but I assure you you'll get some legal issues

Exactly. Which is why you have to research before developing a domain.

definitely something to think about, especially if you are going to invest alot into a project

I think there are alot of people that actually go the opposite way, and think of all the ways they can infringe on trademarks as they register a bunch of names

Definitely. But when you do that you have to be sure you make your money and are aware that you may lose it one day.

agree with you there, often it can be a game of hoping to attain a price that is somewhere in between nothing and what the legal costs might be to the "rightful" owner..... unfortunately it is easy to get "attached" to a project once some time passes and work gets put into it

Shap, when you registered sextube, why did you choose the word "tube" back then?
Did youtube exist back then already ?
Where did the word "tube" originate from by the way (in web context I mean) ?
I know tubes are a mean of underground transportation when I was in London a long time ago and learned what it was.

Smart thinking back then
I just wondered where the whole "tube" names & ideas came from in those years since it's not logical to have the underground subway system name in a porn site, unless the stuff "goes down the tube" as an old saying

Even if a company owns a federally registered trademark, someone else may still have the right to the domain name. For example, many different companies have federally registered the trademark Executive for different goods or services. All of these companies may want www.executive.com but the first one to purchase it"in this case, Executive Software"is the one that acquired the domain name and has the rights to it. If it is an active domain, getting traffic with content, ICANN will usually side with the domain owner. Furthermore, most of these cases are handled by arbitration.

'Tube' in the UK and Eire at least has been used as a slang term for the TV for decades.

A guy called Paul Raymond, in the mid to late 80's, played with the idea of expanding onto TV with a late night slot for his adult business

The name going to be used for the show was...wait for it... Sex Tube, to follow the format of an already running, ground-breaking music show with a similar name - The Tube

Ok, so tube=tv
I thought it was underground transportation/metro.

There was a small hot dog stand near me called "Wee-Dee's" and I guess had been around forever.

The maker of the cereal "Wheaties" sued them to force them to change their name.

You never know when a big company will get a bug up it's ass or bad advice from lawyers on the payroll who could care less about their image and decide to sue someone.

Obviously, don't go making a fruit juice called PepsiJuice but you never know what a big company will do or waste it's resources on.

Tube also = underground/metro

Older TV's were basically a huge cathode ray tube, I guess that's where they got that from.

In my earlier post, the TV show, The Tube, didn't actually derive it's name from tube = TV though.

I haven't read all of the other threads about this but from your logic...

Shouldn't,
sex.com sue you
tube.com sue you
or any other domain with sex or tube in it sue you
?

If you registered sextube before youtube shouldn't you,
sue youtube.com
sue redtube.com
or any other domain with tube in the name
?
