Took me a full 2 mins to kill his youtube version. His host also has a dmca for using photos I own the copyright to. Funny he tried to accuse me of stealing his software and code and going to resell it, when I wasn't even going to do the billing for it. I was selling the product him and I came together. A product that was my concept, my idea, I had to show him how to implement all the features it needed, make sure it worked with remote url call, rtmp and rtmpe, able to work with .flv and .mp4 and h.264 codec. Now he is talking about selling MY CONCEPT, and MY idea that I paid him to develop. Not for him to develop it steal my idea and resell it to others. This is why I am doing NDA's this time and everything will be done using a contract.

She already did that and I promptly showed the signed model releases, id's etc and they were denied. Models DO NOT own the copyright to any photo unless they have a signed contract saying so. Photographer ALWAYS retains full copyright unless as said there is a contract stating otherwise.

What's funny about this drama, is that it's all over a barely mediocre girl who considers taking multiple loads of jizz on her face as a step up in life.

I purposely did not name you, did not drag you into it, no one knew that you had done the work. And you went off on me first on email. I was very cordial with you even after that on email trying to sort the situation out, and you went off on me and accused me of stealing from you. It sounds like you misjudged my email and its intentions, and jumped the gun. I was counting on you in order to launch this thing, and I have been working when I had time to slowly promote what was coming, and then when I am ready to do a press release I simply asked you to help me get a demo up on the site I am going to use to launch the project. Probably would of taken you about 5 mins, and I would of sent you some money on epass to help me even. I in NO WAY was going to sell the player without you getting exactly what we had agreed upon. You should of talked to me further. The player only needs a few revisions, and a few other skins done to be ready to go. I still don't understand why you suddenly went from us being in agreement to you accusing me of trying to steal your code and sell it. And how would I not consider you flakey after we have talked on email for months and I have told you I have been working to gain interest in the project, and waiting till the timing was right to launch. The time was right, I hit you up to make sure all was cool and ask for some help getting the demo running correctly so I could show it to potential buyers. I DID NOT say anything about how the billing would be done. I did NOT SAY that I was going to sell it on my own. I was following the deal that we made to a T.

1. 50/50 split on sale of the player itself.
2. Any customer installs you would receive the money for and I wouldn't take any of the money.
3. Custom skins, changes and tweaks to match customers needs would of been all yours.
4. I would get paid to re encode customer video files to the best format.
5. I would get paid for consulting with the customer.
6. I would get paid for after the player was up and running adding in all the videos, thumbs titles and descriptions etc if that was what the client wanted done (have one right now wanting the full solution)

Billing could of all been figured out, we could of drawn up contracts to cover and make sure the splits were all covered.

I never once said I was taking the player and selling it on my own. That was your huge jump to conclusions. And at that point I needed to find someone to redo the project as this is a good business that could do very well, and it is currently in demand. So I offer and olive branch now. If you want to discuss things and try to work out a resolve to the situation you know how to reach me. Yes I put in my thread that I wanted someone that wasn't flakey, because frankly that is what you did to me. Everyone that has seen this solution has been interested.

And to the folks that don't know. This is a stand alone mini cms video player. Ability to add videos right from an admin area, quick and easy to do. Player is the most secure out there. Very unlikely anyone would be able to easily get your videos out of the members area.

Anyways I've extended the olive branch and its upto you at this point if you want to discuss resolving things and seeing if we can't make some money off work already mostly completed.

All I needed when I emailed was for you to take 2 mins worth of your time and see why the demo wasn't working correctly. I just needed to change one line somewhere so it was set to the new domain name. You would of had a sale and made money right off from the first sale, and made other money for the support aspect. I would of sent you 20.00 or whatever just to get the demo going so I would be able to start showing potential clients. You didn't even ask me about money. This all could of went like this.

Me: I need to get this demo going so I can start gettin us some sales from the site.
You: Oh well do you mind throwing me a bit of money to cover my time until we start getting some sales from it?

Me: Sure how much do you need? I just need to get the demo so it is pointed at the right domain name, we can worry about other skins and stuff etc later on.

Thats how it all should of went. I never asked you to do anything for free, never said I was stealing your code. Simply was trying to get the site setup in order to put out a press release and be able to show potential clients. Billing could go through you, through me, epass, paypal I don't give a fuck. Just so we stay on the same page on everything. Could just have them send 1/2 to my epass, half to yours. However. You jumped to conclusions and none of this should of happened. You accused me of stealing your code and flew off the handle for no reason. If its a big misunderstanding then its something we should be able to work through and solve. Perhaps email or icq would be a better way to communicate about this and see if we can't solve the issue and make some money as we have talked about for months, and I thought we were in agreement on. To claim satire would mean that his work would have to be able to stand on it's own without the use of your images and liknesses. For instance if his video was commenting on the Iraq War but he chose to use images from your site in the video. The Iraq War would be the subject of his commentary and thus his use of your copyrighted material would not be covered.

But he is using your material to comment on you and your situation. Therefore, he is protected.
