XBIZ Exclusive News: AHF to File Cal-OSHA Complaints Against 16 Adult Studios

LOS ANGELES ? The AIDS Healthcare Foundation intends to file formal complaints against 16 adult entertainment companies tomorrow with the California Division of Occupational Safety and Health (Cal-OSHA) in order to push for mandatory condom legislation.

The production companies to be named in the complaints are Anarchy Films, Backend Productions, Blue Pictures, Critical X, Hustler Video (an unnamed DVD title from LFP-distributed X-Play is cited), Heatwave Entertainment, Immoral Productions, Latin Media, Legend, Mayhem, Maverick Entertainment, Raw Flesh, Sin City, Top Dog/Magnus Productions, Vivid Entertainment and Club Jenna.

Wow... this is going to really hurt some companies. The last company that got hit with a Cal-OSHA fine has now moved out of California and is shooting in another state.

This is not going to be easy for these companies to deal with either. Cal-OSHA and the Department of Industrial Relations is like the IRS, guilty until proven innocent.

I dont know if Cal-OSHA has the funds or the manpower to really investigate all these complaints though. California basically being bankrupt may be a saving grace for some.

And here's the kicker...

I went this morning and it was really an AIDS prevention rally. There were about 20-30 people there from AHF and about a dozen reporters from local radio and TV stations.

Only a couple of people were there from the industry. Mark Kernes from AVN and Todd Hunter was there from XBIZ.

For the most part, I dont think AHF really thought this one through. Their house counsel got up and made factually inaccurate legal statements and they dont see how a bloodborne pathogen law can be equally applied to other industries.

I asked the question to Weinstein, CEO of AHF, whether he had thought of the ramifications of making the sharing of bodily fluids completely regulated by Cal-OSHA and he didnt have an answer until I reminded him that there is often bodily fluids exchanged in boxing, MMA, the NFL, NBA and MLB. He went on to state that sweat cannot carry disease -- I reminded one of his attorneys about MRSA, which he even admitted that they had not thought of.

Overall this is a witch hunt against the industry by a group of narrow minded individuals who really havent thought this out. Risk is a part of many professions, you cannot enforce laws against one industry and then say it doesnt apply to another. Too slippery of a slope to go down.

Hopefully Cal-OSHA can see this and will let the complaints die on the vine.

Saw it on the news and came to the same conclusion. If they are gonna tax people more or take money way from education to fight porn, people are gonna be pretty pissed off. What the news showed was a big lazy toothless lion meowing because they are not getting their way.

But Dan Liel the business man, when you get him away from the party is definitely one of the smartest persons you will meet in this business. I am glad that I went to this press conference.

I was interviewed by Channel 7 (the local ABC station) and two local radio stations, after the Mr. Weinstein (the main speaker) dismissed, and didn't want to listen to, what I had to say.

My main points are

Why single out 16 companies in California?

If they are truly concerned with the welfare of performer's work on a unilateral Nationwide policy.

If they were to pass a law only in California, the already fragmented adult industry would scatter, go underground, and/or move overseas.

Mr. Weinstein was surprised when I talked to him one and one after the press conferene, and told him that there is production in every single major, metro, area in the country.

Hi, Question for all....

Why NOT use a condom in every scene?

It's safer for everyone (tests can be wrong). Besides AIDS, you're protected from getting a bunch of other cooties too. If I were a performer I would much rather work for a studio that enforces condom use and that works only with models who always use condoms.

If I were a studio owner I would be want to reduce my liability. Can't a model sue a studio if he or she contracts aids from someone he or she shot with at your studio?. Wouldn't a studio's insurance rates go down if condom use was mandatory?

Are condoms not used mostly because it affects sales? Do porn buyers prefer bareback only? (Is there market research that shows this?)

What if the adult industry in California simply decided to self regulate and require condom use on set before being legally forced into it?

I suppose that some might say that in porn, seeing a condom may take away from the fantasy. For me, "safe" is pretty damn sexy.

If they are really looking out for the best interest of performers and have a mandatory condom policy it should be Nationwide.

If it they have they try and enforce a condoms only policy in the State of California, production companies will pack up and move.

The situation will become much worse than it is today, as we will be faced a very fragmented, underground, production envirnoment, with no regulation.

I do have to give Dan credit for attending, but yeah, why put wider ideas into people's heads? Wouldn't surprise me if they're next press release quotes him out of context as "porn producer thinks our proposal should go nationwide!!!" For that matter, some other morality or religious group could co-opt it, that kind of stuff is gold to them.
