Another Acacia wannabe targets (adult) webcam sites

MARSHALL, Texas ? A patent holding company has sued some of the top names in the adult live-cam business, claiming they all are infringing on a patent.

XBIZ has learned that the targeted adult operators include Playboy Enterprises, Penthouse Media Group, LFP Internet Group, FriendFinder?s Steamray Inc., Vivid Entertainment, Playboy's ClubJenna unit, Anabolic Video Productions, Evil Angel Productions, New Destiny Internet Group, Shane Enterprises and Private Media Group?s GameLink.

The suit also includes mainstream companies TrueBeginnings and Woo Media.

The allegedly infringing websites include AnabolicLive.com, HomeGrownCams.com, VividLive.com, PlayboyLive.com, EvilAngelLive.com, GameLinkLive.com, SpiceLive.com, Penthouse.com, AdultFriendFinder.com, HustlerLive.com, True.com, ShanesWorldLive.com, WooMe.com and ClubJennaLive.com.

Each of the companies are being sued by patent holding company Joao Control and Monitoring Systems at U.S. District Court in Tyler, Texas.

They all are allegedly infringing on U.S. Patent No. 7,277,010 by making, using or selling video monitoring and communications apparatus and services that are defined by the patent, according to the suit.......

I quickly read through the patent, its quite a stretch to apply a patent on remote security monitoring to webcams, but filing the lawsuits in East Texas just makes it move obvious that this is a wannabe Acacia... looking to pick off the "low hanging" fruit of companies they think will just settle, rather than be litigated in East Texas.

Apparently the patent holder didn't do much research in seeing qho fought against patent abuse. Alot of other cams systems left out of the initial party list.

It's not the first nor the last - and soon a lawyer will jump in and a trade show with fear saying we need to take it seriously. Larger companies will just pay up to get rid of them vs. paying lawyers to win. With larger companies paying minimal amounts it gives them the idea now that they can go after the small guy.. and so on. and so on.. next will be condom companies suing the industry for using their product in making movies and would want a piece of the action since it wasn't for personal or private usage.

all but a couple of those are just white label skin jobs - they aren't running a cam business, they're affiliates.

the patent holder probably didn't know that.. or, they may cover by saying they are targeting "contributory infringers"... that white labels and affiliates could also be sued...

Judge Ware invalidated all of Acacia's remaining claims in a decision issued in September. It might not be the END of the story, though, because Acacia can still appeal the decision.
