OiNK Admin Found Not Guilty, Walks Free

Quote:
Lawyers have presented their final arguments in the trial of Alan Ellis. The prosecution slammed the ex-OiNK admin, saying that the site was set up with dishonest and profiteering intentions right from the start. The defense tore into IFPI and countered by calling Ellis an innovator with talents to be nurtured. Today the jury returned a unanimous verdict of not guilty, and Ellis walked free.

So many supporters of piracy .. makes me wonder what really really goes on through these people's minds when they steal something and use it for free .... why they feel they have some kind of moral high ground.

Seriously, baffles the hell out of me.

I see piracy as the same as stealing an item from a shop.

Well, I don't know if you're for or against, since your post made little sense

he is of the opinion that if 1 cd is sold the person has every right to give it to everyone on earth , while profitiing off it, and the artist gets nothing but the cut off 1 cd.

he likely also believes pigs fly and the earth is flat, so i wouldn't get too in to any debate

Well, CD's do say for home use and no public performance, lending, copying etc... so he's of course wrong on every level

Don't get me started on the difference between a porn torrent site and a strictly-for-good-music torrent site.

I had someone put my own releases up on Oink and it only helped my promotions.

More people listen to your music = Fans at your show. Artists make MOST of their income by touring.

If I had a shop with a great product, I'd love to be able to give everyone who wanted one, a free sample at absolutely no cost to myself!

Just sayin.

I think the issue is one of "choice of the creator"; torrents helped you but they don't
help Madonna/Prince/Britney Spears etc... They are just losing sales/money that they
can make through MTV and radio.

There wouldn't be an issue if the artist could decided if they wanted their music on it
or not. Some would do it and some would not.
Simple matter of "let me control my own stuff please".

Your argument falls flat. It's irrelevant. MOST artists do NOT want to give away music for nothing. You don't know how the music industry works. You may think you do because you make music. Well, so do I ... I make pretty good music too :P But that doesn't mean I know shit about the industry, and I do not agree with piracy.

Anyway ... why pirate music when you can listen to it all legally on www.spotify.com

How would you like your mascots being used for free by websites ... who then said "Well, it's exposure for you isn't it?"

You'd be pretty fucked off.

nope never said that once, however once you bought the music you have a right to back up and recover it using any technology available.

i suggest you read the copyright act
every copyright holder explictly grants a purchase a whole bunch of rights automatically (fair use) when they accept the exclusive rights under the act.

if what you were saying every single second hand cd store would be illegal.

Simple matter of "let me control my own stuff please".
copyright is a CONDITIONAL monopoly so this bullshit about creators having complete and absolute control is total bullshit.

you don't have a right to demand people pay you twice for the same right to listen

oink provided a service that allowed buyers recover the stuff they bought (really money or piracy tax)
it could be abused by people who didn't pay for the stuff get it for free, those are the people who should be found and procecuted.

just like the vcr you don't sue walmart for selling the devices, you go after the guys daisy chaining them together to make unauthorized copies (fair use or explictly)
