How the fuck did the adult industry ever get itself into this nasty predicament, where it is actually legal to steal content? Nowadays, a big chunk of our industry is making hundreds of millions of dollars per year stealing content. Unbelievable.

thats kind of a bland statement. someone can't legally pay $30 for a realitycash membership and download and then give away all their videos. A person cant legally upload one of realitycash's videos for public viewing

The fact is that law cant and wont change because it would kill user-generated content sites, including legal ones like youtube, and push the internet back 10 years.

Tubes are owned by either former affiliates or programs...probably best way to avoid it is stay off the boards.

We're a smaller program but I sure would appreciate if people notified us if they see our content given away for free...especially being in micro-niches.

Parody is a good example to use to describe how it works.

Do you think i could give away every blockbuster film on a website and simply put "this website is a parody" and not get sued ? obviously not. What if i add some words under it that says "poo poo caca silly movie" ? answers start to get a bit more fuzzy. What if i sell memberhip to my site for $100 a year and give away every new movie with some actual parody like science fiction 2000 ?

In youjizz case parody isn't applicable. but i would imagine some argument could be made for profiting off the residual traffic based on keywords and images that were from stolen content. No attempt has been made it seems to have the pages no longer spidered thru the use of common methods such as "noindex" etc.

we had this arguement before and i schooled you on how you taking the statement out of context to misrepresent what was being said.

The two supporting links that were used to justify this statement were SCOPE changes in fair use (timeshifting being one of them)

the misrepresentation that the fundamental principle of legal precedent doesn't apply to fair use and that it must be evaluated each time based on the blind whim of the judge is totally and completely false.

claiming that something is a parody doesn't make it a parody, likewise claiming that it is not doesn't stop a valid parody from being a parody.

the arguement that is going to be used and currently being used by youtube is commentary not parody. The extension of commentary to cover "look at my favorite quest crew dance routine" and the spark of free expression and commentary that follows such posting would protect all of the tube site you are complaining about. And since SCOPE changes is what the quote you are misrepresenting as fundemental violation of the basic principle of US legal system would apply to all of them too they would be equally protected.

does have to be, luckly since there are so many different fair use that they could use including commentary (youtube) , timeshifting and access shifting (although those would have to be defended by the uploader so less likely to be used).

well a site can have a video up as long as they want cause of user submission until a notice is sent, its not fair, but yes its legal.
