:mad Notice of Termination due to New California Law (Amazon Associates)

Unfortunately, Governor Brown has signed into law the bill that we emailed you about earlier today. As a result of this, contracts with all California residents participating in the Amazon Associates Program are terminated effective today, June 29, 2011. Those California residents will no longer receive advertising fees for sales referred to Amazon.com, Endless.com, MYHABIT.COM or SmallParts.com. Please be assured that all qualifying advertising fees earned before today will be processed and paid in full in accordance with the regular payment schedule.

You are receiving this email because our records indicate that you are a resident of California. If you are not currently a resident of California, or if you are relocating to another state in the near future, you can manage the details of your Associates account here. And if you relocate to another state in the near future please contact us for reinstatement into the Amazon Associates Program.

To avoid confusion, we would like to clarify that this development will only impact our ability to offer the Associates Program to California residents and will not affect your ability to purchase from Amazon.com, Endless.com, MYHABIT.COM or SmallParts.com.

We have enjoyed working with you and other California-based participants in the Amazon Associates Program and, if this situation is rectified, would very much welcome the opportunity to re-open our Associates Program to California residents. As mentioned before, we are continuing to work on alternative ways to help California residents monetize their websites and we will be sure to contact you when these become available.

Regards,

The Amazon Associates Team

Just like several other states. It's the states' fault(s) for demanding taxes because they want to say that every affiliate is a "physical presence" just like an actual store would be and therefore since they have a "physical presence" in the state, they MUST collect sales taxes. Texas sent Amazon a 269 billion dollar tax bill claiming that's what they owe for all of their "unpaid" taxes. Overstock.com will do it too.

It's been done in New York, North Carolina, Hawaii, Rhode Island and Colorado, and like I said Texas will no doubt be next. They're trying to demand all this money, and all they're doing is killing small businesses in the form of affiliates.

Amazon has a point. Once they've chopped off ALL 50 states affiliates (where else is the end game if not there?), then how can state governments claim they have to collect sales tax? Amazon bets that they can't, and then they'll be able to stop collecting sales tax.

States are screwing their own states' online affiliates by saying their home is a store because proactive companies are nuking them in protest.

I don't understand why they are cutting off the affiliates, consumers from the state buying from Amazon will still be taxed based on this new law. Sounds more like they are just cutting out their affiliate model.

CT as well.

In a nutshell, the States are attempting to collect tax revenue from Amazon affiliates sales (not so much the affiliates themselves) because those affiliates reside in said State. Currently no taxes are collected because Amazon does NOT reside in said States or a State with a sales tax, Seattle, Washington. To combat/protest the issue Amazon is teminating all affiliate accounts in said State making the bill/law moot.

In the end the States get nothing and the affiliates lose.

They always focus on Taxing everyone. How about CUT SPENDING if you can't afford it?

However, I can see this point.

Quote:
Not collecting sales taxes gave Internet retailers a competitive price advantage over California's small businesses such as independent booksellers and big-box retailers with a presence in the state, including Barnes & Noble Inc., Wal-Mart Stores Inc., Best Buy Co. and Target Corp.

"You can't give one segment of retail a 10% discount every day. It's just not fair," said Bill Dombrowski, president of the California Retailers Assn., a major player in a coalition of large and small stores supporting the legislation.

1 800 businesses have avoided collecting taxes and still do though. It's because the internet is popular as all hell with millions of people spending billions of dollars.. THEN it got the state's notice. Big money.

The latest state to jump in the online sales tax revenue trough is California whose governor signed legislation earlier this week. The new law would mandate sales tax collections from online retailers who maintain a physical presence in the state which would include affiliates.

And then in the other link posted...

(The bill) specifically imposes the collection of taxes from consumers on sales by online retailers ? including but not limited to those referred by California-based marketing affiliates like you ? even if those retailers have no physical presence in the state.

Those two words don't fit well with this administration or mores specifically in democratically controlled states.

The tax in question is sales tax for goods that amazon sells... the reason that affiliates are mixed up in this, is the new law states that if you pay affiliates in California, then that is considered doing business in California and so sales tax needs to be collected...

at least that's how I understand it...

I did not read the article, as I should, BUT
are they wanting to collect SALES tax? Or Affiliate INCOME tax??
anyway, seems if more states are going to this, I would figure a way to collect taxes instead of losing all the affiliates...

Oh, thanks!

Well, I would Quit trying to find a loop hole in not having people pay sales tax, and just charge sales tax. I would think checking to see if the sale came from an affiliate in CA or not, before applying sales tax is more trouble than charging each states sales tax...

I need to correct this. Amanzon does collect sales tax for Kansas sales because of the Coffeyville distribution Center but has NOT cut off Kansas affiliates.

It is not a "loophole" and I will soon be both discussing this matter and offering a legal and ethical solution for banned Amazon affilates on the Mainstream forum, regardless in which of the banned states they live.

Wow, ya all this so Amazon can avoid paying taxes. If some day they are obligated by law to pay state taxes, their stock is going to plummet by 30 - 50%.

In this instance, Amazon does NOT "pay taxes" but instead acts as a TAX COLLECTOR for the various states and the taxes collected are passed on the the customer.

Not really. The business does not pay taxes. A business collects the sales tax from the consumer then passes it to the state.

This really is a fair law, why should a business in your community be at a disadvantage overall price wise compared to an internet business? Also the state will just collect taxes from you in other forms to make up the shortcoming.

Guess what's going to happen to THAT thread.

Actually states are protecting their income. Also do you really think staters care more for some guy working from home or an actual retailer paying sales tax, property tax, employing workers, etc .....

If you want to try to screw up a legal and ethical solution to the problems faced by Amazon affiliates in Amazon banned states, you just go right ahead. In fact, I wish you would because you and your fellow haters will show yourselves for what you really are.

You would rather that the banned Amazon affilates remain banned and lose their ability to earn because you want to fuck with me and that will be obvious to all who view the thread.

You have already outed yourself but you have a nice day anyway.

Whatever happened with that? I'm thinking Amazon filed it in the shredder but I could be wrong. :D

Couldn't Amazon just add some code into their existing script that identifies which state the purchaser is in and then add on the applicable state sales tax? Problem solved, no?

This is just the beginning. Every state is hurting for money. That the Internet is not taxed is just killing the lazy politicians. A little bit at a time until every transaction on the web is taxed. That's what is coming so you better be prepared for it.

There is too much money on the table for it to be ignored any more.

It's the ship to state, that info is already there as the delivery address.
