I usually try to resolve such things in professional private matter. I've been patiently waiting for a long time and now not interested running trying to catch tails and to get fingers pointing other ways that you are not in charge or were not in charge at the time. That is not my issue. There is a debt carried or inherited by above mentioned programs to my design company SilverCrocodile. We've always went extra mile for RehabDollars working overtime and weekends when things were needed promptly. I see these programs are still running and join pages seem functional.

You owe us $x,xxx for February - early March work, before WMC issue occurred
You owe us $xxx for early April work
You owe us $xxx for early May work

Your programs are using our work with disregard of it being paid for. Yes I appreciate business you brought us throughout past year and it was actually nice working with you while it lasted that why I've been so patient about this for such a long time.

Here's how we worked:
Moses sent orders and provided feedback, I sent him invoices and money came from SOBV
Now I have a feeling no one will claim responsibility of the money owed and actually pay overdue balance.

For anyone else, be careful how you conduct your business, even with existing long term clients.

Starting this year they insisted to pay at the end of a month for month worth of work. Stupid mistake on my part I agreed to such arrangement. While slow business early this year I also had to cover for this work out of my own pocket. What a joy that was.

There was hope when affiliates got delayed payments for April pay periods while I was patiently waiting for my cut. Now there is no hope left. If these programs actually changed hands as rumors say, old owners will say they don't run it any longer, new owners will say they had no dealings back then while program continues to use our unpaid work. although I highly doubt anyone will say anything at all.

CCBill was onto this type of shit years ago. They still are, and will always be number one. No offense to NATS but it is useless as far as affiliate trust is concerned. I am not saying that is why NATS is the way it is... but that's the way it is.

Third party tracking and payout is the way it should be for now, until of course nobody wants to deal with affiliates... which is usually when the bank account run dry

I know, we are no affiliates though - we did designs for them, but it doesn't matter everyone deserves what they earned.
we were supposedly be first in line, they delayed Feb-March payments, then WMC happened, then in May or early June you guys got paid for April, while we are still waiting to get paid for Feb-Mar work we did.

You actually have a remedy that most people don?t have. If they are currently using your work in their member?s area, site, tours, promotional stuff, ect. send them a DMCA.

In short unless you gave them a written assignment of rights to use your stuff your company retains copyright in all the materials your company produced. Send their host the same DMCA specifying where your works are on their sites including the URLs. The host will jerk their sites down for copyright violations to avoid copyright liability themselves. Depending on how vital your designs are to their various sites they will have to pay you if they want to keep the sites up. If nobody pays and the sites go down then you know there is nothing to get. Either way it won?t take you more than 30 minutes of work.

This post shows an utter lack of understanding of how paysite programs work.

For starters CCBill and nats are 2 utterly different things. Infact many nats sponsors process through CCBill so the two aren't mutually exclusive.

This is an interesting idea, never dealt with DCMA, going have to look into it. Although they can take it down or didn't even put it up; as unpaid only is a "small" portion of mostly promo work. Actually just checked invoices, there are some sites in there too, not their main once, those where taken care of last year.

There are some good sample forms online. Like I said the actual work of it won’t take you more than 30 minutes just identify where your work is on their sites, by URL and filename. Prepare the DMCA on one of those forms and send it electronically to SOBV and their host. Then sit back and see what happens. Technically copyright belongs to you unless you gave them a written assignment of the various works created it really doesn’t have anything to do with payment or nonpayment. So if you didn’t give them a release on those main sites a few years back you can assert copyright on those as well. I suspect as in most cases it was never even discussed, but this gives you some major leverage. Obviously what you’re fishing for is for is them to pay you, and at that point you can release your copyright claims on all your works you did for them.

btw word is that SOBV screwed K-man and Moses just like us and all their affiliates. from what I've heard, SOBV holds all unpaid RehabDollars money except the portion that was frozen at WMC in April. I can't verify or prove any of this, take it for what it's worth.

Would be great if SOBV stepped in and brought the light on the situation or better yet pay out what is owed. Before this incident SOBV had a solid reputation regarding payout outs.

It was mistake on my part agreeing and trusting to get paid after each month, otherwise I wouldn't be in this situation. Now we're only doing 50/50 deals - 50% before work starts and 50% at completion before HTML/PSD shown and delivered; 100% upfront on small orders. You can never know who and when will go down for whatever reasons. I'm not interested affording and "investing" in unnecessary risks.
