If the ICM's .xxx is approved, it will hurt you alot more than what's happening now with ePassporte!

Over the last 2 days, the ICM has been sending in lots of emails from people who are obviously not part of the industry.

It's time you let your voice be heard! Take 2 minutes of your time and email your objections to the .xxx tld to [email protected].

"I run adult websites and I do NOT want the .xxx tld!" is al you need to put in your mail.


If you think you got hit hard because of this whole epassporte mess, then you'll be out of business for good if the ICM's .xxx tld ever gets the green light.

No one has explained yet how federal government in the USA can mandate that all websites of some type can go under the direct control of a private company. With this stupid thinking, why not worry that tomorrow, all private business will need license from Walmart to operate?

To do it as a truly global measure would be very difficult, probably even impossible.

To require that all U.S.-based adult sites operate on .XXX domains, and those that have a "U.S. nexus" and/or enter into the U.S. stream of commerce to be displayed on .XXX or be blocked from access by Americans, on the other hand... that probably is within the reach of Congressional authority.

Consider this: we do have, and enforce, laws in this country that come equipped with "extraterritorial jurisdiction." It is against the UIGEA to accept online gaming wagers from American citizens, for example. If you don't think citizens of foreign countries can be charged under that law.... well, just ask David Carruthers from BetOnSports about that.

Having said that, fear of .XXX becoming mandatory is not why I'm against ICM's proposal. I just tend to hesitate in offering my support for things that are entirely undefined, as the prospective rules and policies of IFFOR remain, to this day.

Want my support? The first step is telling me precisely what you're asking me to support -- especially when you are asking me to spend $60/domain as part of "supporting" you.

It really doesn't seem like that much to ask, honestly.

I didn't mean that it would be difficult in a technical sense. I meant it would be difficult to coordinate an internationally-binding legal requirement to host adult content on the .XXX TLD.

I understand the "ICANN is dependent on the U.S. government" theory of how .XXX could become mandatory, internationally. I just think it would be significantly more complicated than Congress passing a law, then calling up ICANN and demanding that ICANN assist in enforcing that law. ICANN might be dependent on the U.S. government, but it does not follow that ICANN is an indentured servant to the U.S. government.

This matter would quickly end up in court, and the courts (both domestic and international) most assuredly exercise power independent of the U.S. Congress. If they did not, COPA would be the law of the land, and the .XXX question would be largely moot for American website operators.

Regardless, I'm against .XXX, either way. Even if it were clearly impossible for it to become mandatory under any circumstances, I'd still be against .XXX for the reasons I stated in my comments to ICANN, ranging from the first comments I submitted to the most recent ones.
