GFY armchair lawyers, what's the deal?

My buddy rented out some office space from a guy here in town. The guy has since (I think about 6 months or so into the lease agreement) been sentenced to prison until 2084 (LOL) for some CP he had on his PC and his ex wife caught the dvd burnt in a box somewhere.

At the time the guy leased the joint, he had no clue that this was ongoing. Think it's safe to walk away from that shit? He is now getting hounded by some prison whore claiming to have power of attorney and actually got served an eviction letter from the cunt.

I told him to tell her to fuck off until proof was established, things were done formally. The bitch claims to have a lawyer yet the eviction letter he received was a cut and paste job from the web.

Repercussions? Walk away? Ride it out? Mind you, there is a fair sum of money in security as well that he will never see again. I know an agreement is an agreement, but come onnnn?

EDIT: Also, this person demanding funds... must they prove Power of Attorney or does he take their word for it?

Over here, you must present your power of attorney whenever doing anything. I'm not sure how it works in the states, but an eviction letter from her without the power of attorney attached is toilet paper. It's as valid as you sending him an eviction letter for that property.

Not sure how it works here either. I wouldn't be here if I was indeed a lawyer. But I'm thinking the same thing. Thanks for chiming in

Think of it this way. If your buddy was in jail, and he gave you a power of attorney to pick up his mail from the post office, you would have to present it every time to pick the mail up. It's gotta be the same in this situation. She needs to present that she is authorized to evict him. Also if they had any lawyer, he probably wouldn't be locked up until 2084 :P

If it were me I would force them to show me power of attorney before doing anything else. If he wants to stay there then he may have to deal with her. If he doesn't care and is willing to move, he can always just walk away or negotiate a break in the lease. If she is trying to evict him then clearly she shouldn't care if he walks away.

I personally would take into consideration how long the lease was for and how much it could end up costing me if I had to pay for he full remaining lease. If it wasn't too bad and she wouldn't negotiate a break in the lease, I would walk away. If she tries to sue he can always go to court and argue that he didn't want to have anything to do with a guy that is convicted of CP and that you tried in good faith to negotiate a break.

It sounds like she might be a little crazy so if it were me I would do whatever I needed to in order to get away from her.
